RELATIVELY SHORT PRESENTATION ON FEDERAL LEGISLATION, AS CONGRESS WAS LARGELY IN RECESS OVER THE HOLIDAYS AND THE STATE IS STILL GEARING UP FOR THEIR BILL INTRODUCTION OF TOWARD THE END OF FEBRUARY OR MIDDLE OF FEBRUARY. WE DO HAVE THREE BILLS TO CONSIDER. FIRST IT'S CALLED THE REPAIR ACT, WHICH STANDS FOR RESTORING ESSENTIAL PUBLIC ACCESS AND IMPROVING RESILIENT INFRASTRUCTURE ACT. AND REALLY WHAT THIS PROGRAM DOES IS IT REAUTHORIZES AN ELEMENT OF THE BIPARTISAN INFRASTRUCTURE LAW THAT CREATED A GRANT PROGRAM FOR IMPROVING TRANSPORTATION CONNECTIVITY. AS PART OF THAT, IT INCLUDED ACTIVE TRANSPORTATION CORRIDORS AND PAVED TRAILS. IT ALSO EMPHASIZED WALKABLE COMMUNITIES AND PARKS AND OPEN SPACE AS A FEATURE OF THOSE KIND OF COMMUNITIES. SO IT COULD POTENTIALLY BENEFIT THE PARK DISTRICT. SO THIS WOULD REAUTHORIZE IT AND ADD ADDITIONAL FUNDING TO THE GRANT PROGRAM. SECOND BILL IS REGARDING KEEPING OR HAVING FREE PUBLIC ACCESS TO FEDERAL RECREATIONAL LANDS ON RECOGNIZED HOLIDAYS AND RECOGNIZED DAYS THAT ARE OF SIGNIFICANCE TO FEDERAL LANDS, WHICH DOES INCLUDE THE GREAT AMERICAN OUTDOORS DAY AND NATIONAL PUBLIC LANDS DAY. AND THOSE ARE DAYS THAT THE PARK DISTRICT DOESN'T RECOGNIZE, BUT ALL THE OTHER DAYS THAT THIS LEGISLATION WOULD EMPHASIZE, INCLUDING MLK DAY, JUNETEENTH, AND THE OTHER ONES, OUR PARKS WOULD ALREADY BE OPEN BY OUR OWN POLICY. BUT THIS IS TO HELP WITH THE FEDERAL LANDS AND NATIONAL PARKS. AND THEN THE THIRD BILL IS REGARDING HISTORIC PRESERVATION FUND. THAT PROGRAM NEEDS TO BE REAUTHORIZED, AND THIS LEGISLATION WOULD REAUTHORIZE IT AND ADD ADDITIONAL RESOURCES AND ENSURE THAT 40% OF THE FUNDS GO TO STATE HISTORIC PRESERVATION OFFICES. AND THAT COULD BE HELPFUL FOR CALIFORNIA STATE HISTORIC PRESERVATION OFFICE, WHO HAS HAD CHALLENGES WITH FUNDING AND STAFFING LEVELS. SO WE'RE ASKING THE SUPPORT FOR THOSE THREE LEGISLATIVE ITEMS. SO WE'RE KIND OF THE FIRST MEETING OF THE YEAR. WE OFTEN COME TO THIS COMMITTEE TO REPORT ON RECENT ACTIONS BY OTHER JURISDICTIONS. WE'RE JUST COMING OFF OF THE HOLIDAY SEASON. SO THERE'S NOT ALWAYS A WHOLE LOT TO REPORT ON THAT AT THE FIRST PART OF THE YEAR. BUT WE THOUGHT WE'D TAKE THE OPPORTUNITY TO JUST KIND OF GIVE AN OVERVIEW. I KNOW MEMBERS OF THE COMMITTEE LARGELY UNDERSTAND WHAT THIS WORK IS. SO I APOLOGIZE IF IT'S REDUNDANT, BUT WE FEEL IT'S GOOD TO ALWAYS SORT OF, YOU KNOW, REFRESH IT, THE NEW STAFF, NEW BOARD MEMBERS OR OTHERS TO JUST SORT OF, YOU KNOW, HIGHLIGHT THIS WORK THAT I THINK IS NOT NECESSARILY UNIQUE TO THE PARK DISTRICT, BUT IT'S PRETTY EFFECTIVE FOR US, AND I THINK IT'S ALSO RELEVANT JUST COMING OFF OF OUR BUDGET CONVERSATIONS AROUND MEASURE WW AND ALSO SETS US UP A LITTLE BIT FOR CONVERSATIONS THAT WE HAD DURING THE LAND SESSION ON FEBRUARY 6TH. SO I AM JOINED TODAY WITH OUR INTERAGENCY PLANNING TEAM. SO NEOMA LAVALLE IS OUR PLANNING MANAGER, WHO'S BEEN LEADING A LOT OF THIS WORK FOR A LONG TIME. KIM THAI, WHO JUST RECENTLY PROMOTED INTO PRINCIPAL PLANNER ROLE, AND TANYA COVARRUBIAS, OUR PLANNER, WHO LEADS OUR SAGE PROCESS. SO THEY'RE ALWAYS AVAILABLE TO ANSWER ANY QUESTIONS ON THINGS THAT ARE GOING ON AROUND THE OUTSIDE OF OUR PARKS. SO WHEN I STARTED HERE 20 YEARS AGO, THERE WAS THIS LITTLE PROCESS THAT WAS CALLED THE GAG PROCESS. AND SO EVERY MONDAY WE WOULD GET OUR THOMAS BROTHERS MAP BOOKS AND WE WOULD GET TOGETHER IN A CONFERENCE ROOM, AND WE WOULD GO OVER A BIG STACK OF AGENDAS THAT WE RECEIVED FROM ALL THE OTHER CITIES IN THE EAST BAY, AND WE'D FUNNEL THROUGH THE THOMAS BROTHERS BOOKS AND KIND OF LOOK AND SEE WHERE PROJECTS WERE HAPPENING AND IF THEY IMPACTED US. AND THEN WE WOULD SUBMIT AND THEN WE WOULD GO FROM THERE. WE'VE CHANGED THAT. WE THOUGHT THE GAG ACRONYM WAS MAYBE A LITTLE BIT DEROGATORY. SO WE CHANGED IT TO SAGE, WHICH IS THE STRATEGIC ACTIONS OF GOVERNMENTAL ENTITIES. SO MAYBE A LITTLE BIT LOFTIER BUT NOT AS BAD AS GAG. AND THEN NOW WE HAVE TOOLS LIKE OUR GIS AND OTHER DIGITAL TECHNOLOGIES. SO I THINK I STILL HAVE MY THOMAS BROTHERS BOOK THAT HAS THINGS MARKED UP IN IT, BUT WE NOW DO A LOT OF THIS ONLINE. SIMILARLY, WE GET ALL OF OUR AGENDAS MOSTLY ONLINE NOW. SO REALLY THE KEY FUNCTION OF INTERAGENCY PLANNING IS, AS THE BOARD KNOWS, WITHIN THE ALAMEDA AND CONTRA COSTA COUNTY WE WORK WITH THE TWO COUNTIES, WE WORK WITH THE. I ALWAYS GET THIS NUMBER WRONG, BUT IT'S 33 CITIES OR SOMETHING ALONG THOSE LINES. A WHOLE BUNCH OF OTHER SPECIAL DISTRICTS. AND EACH TIME THESE AGENCIES ARE PRODUCING OR PROCESSING PROJECTS THAT OCCUR. NEAR OUR PARKLANDS OR OUR TRAILS, WE GET PROJECT REFERRALS. AND THAT COULD BE CEQA DOCUMENTS OR JUST AN AGENDA OR WHATEVER IT IS. AND SOMETIMES THEY NEED SOMETHING FROM US. SO THAT'S, YOU KNOW, NEED LAND. SOMETIMES WE'RE JUST, YOU KNOW, INTERESTED IN IT. SO THESE AGENDAS COME TO US. OUR TEAM REVIEWS THEM, DETERMINES IF IT DOES HAVE ANY RELEVANCE TO THE PARK DISTRICT. IF IT DOES, THEY GENERALLY SHARE THAT WITH OTHER MEMBERS OF USUALLY IN THE ASP DIVISION, BUT IF IT GOES BEYOND THAT AS WELL TO JUST SEE WHAT THE INTERESTS ARE AND THEN WE KIND OF GO FROM THERE. SO WE'LL WE'LL TALK A LITTLE BIT ABOUT WHAT THAT PROCESS IS, BUT IT'S REALLY ALL ABOUT KIND OF MONITORING THESE PROJECTS THAT ARE PROCESSED BY THE OTHER JURISDICTIONS AROUND THE PARK DISTRICT. THIS GIVES US AN EARLY OPPORTUNITY TO ENGAGE WITH OUTSIDE AGENCIES TO ADVOCATE FOR OUR PARK DISTRICT INTERESTS. WE HAVE TRADITIONALLY REPORTED ON THESE ACTIONS EITHER TO THE FULL BOARD, OR AND THEN NOW WE'VE BEEN COMING TO THE BOARD LEGISLATIVE COMMITTEE TO REPORT ON THESE ACTIONS. AND OFTEN THESE RESULT IN LAND COMING TO THE PARK DISTRICT OR SOME OTHER SORT OF, SOMETIMES THERE'S BEEN FUNDING AGREEMENTS OR OTHER AMENITIES OR PERHAPS PROJECT CONCESSIONS. PERHAPS A PROJECT IS REDUCED BECAUSE OF IMPACTS TO THE PARK DISTRICT. BUT USUALLY THERE'S SOME SORT OF SOMETHING THAT COMES OUT OF IT. AND REALLY, WE'RE KIND OF GUIDED BY THIS LITTLE LINE IN THE MASTER PLAN VISION STATEMENT THAT JUST SAYS THAT, YOU KNOW, PART OF THE PARK DISTRICT'S VISION IS TO CONTINUE TO PROVIDE LEADERSHIP TO GUIDE LAND USE DECISIONS IN THE EAST BAY THAT RELATE TO THE DISTRICT. SO THAT'S REALLY WHERE WE KIND OF TAKE THAT PRIVILEGE OF ENGAGING DIRECTLY WITH SOME OF OUR PARTNER AGENCIES. SO AGAIN, WE HAVE THE SAGE PROCESS, WHICH IS REVIEWING AGENDAS AND PROJECT REFERRALS. SO WE RECEIVE A LOT OF THESE AND JUST FOR, YOU KNOW, STAFF OR OTHERS WHO ARE LISTENING, AS YOU, YOU KNOW, GET WE OFTEN TELL OUR PARTNERS IN OPERATIONS WHO WILL RECEIVE NOTICES IN THEIR MAILBOXES JUST BECAUSE THEY'RE LOCATED CLOSE TO JUST SEND THOSE AGENDAS OVER TO US, AND OUR TEAM USUALLY REVIEWS THEM. AND THEN WE DEVELOP A, YOU KNOW, COMMENT LETTERS OR WHATEVER IS NEEDED TO SORT OF RESPOND TO THAT. WE TRACK ALL OF THESE DEVELOPMENT ACTIVITIES ACROSS THE EAST BAY. YOU KNOW, I ALWAYS KIND OF SAY IT'S SORT OF OUR CHARGE TO KIND OF KNOW WHAT'S HAPPENING EVERYWHERE IN THE EAST BAY ALL THE TIME. WE DON'T, YOU KNOW, THAT'S OBVIOUSLY AN IMPOSSIBLE GOAL, BUT WE THINK WE DO PRETTY GOOD AT IT. SO ANY TIME THE BOARD HAS QUESTIONS OR IF YOU HEAR FROM CONSTITUENTS ABOUT, YOU KNOW, A PROJECT THAT'S OCCURRING AROUND ONE OF THE PARKLANDS IN YOUR WARD AND YOU HAVE QUESTIONS, YOU KNOW, GENERALLY YOU COULD JUST GIVE US A CALL. WE OFTEN KNOW THE ANSWER. IF WE DON'T, WE USUALLY KNOW WHERE TO GO GET THE INFORMATION. SO WE CAN SORT OF PULL THAT UP AND LET YOU KNOW HOW THAT WOULD IMPACT US. AND IF WE'VE ENGAGED IN THE PAST OR REALLY, WHAT SORT OF RESPONSE IS NEEDED ON THE PART OF THE DISTRICT. THESE OFTEN RESULT IN CONDITIONS OF APPROVALS, COAS. SO THESE ARE CONDITIONS THAT ARE ATTACHED TO THE PROJECT THAT ARE, YOU KNOW, SOMEWHAT LEGALLY ENFORCEABLE, THAT WE HAVE THE OPPORTUNITY AS A PROJECT MOVES THROUGH ITS LIFE CYCLE TO CONTINUE TO MAKE SURE THAT IT'S IMPLEMENTED, IT'S DOING WHAT WAS PROMISED TO THE PARK DISTRICT. SO SOME OF THESE THINGS CAN TAKE DECADES. SO IT'S GOOD TO GET THESE CONDITIONS SORT OF WRITTEN INTO THE RECORD. AND WE HAVE THE ABILITY TO CONTINUE TO TRACK THOSE AS PROJECTS COME BACK. AND THEN WE MAINTAIN A LOT OF THIS IN OUR GIS SYSTEM, JUST SO WE CAN SORT OF REPORT ON IT. THESE OFTEN RESULT IN SOME LEVEL OF, YOU KNOW, SORT OF DIRECT NEGOTIATIONS, WHETHER IT'S WITH A PROJECT DEVELOPER OR A CITY. OFTEN WE WILL HEAR FROM STAKEHOLDERS WHO MIGHT BE CONCERNED ABOUT A PROJECT, AND THEN WE'LL REACH OUT TO THE PARK DISTRICT AND ASK WHAT WE'RE DOING ABOUT IT. SO WE ENGAGE OFTEN WITH OUR STAKEHOLDERS WHO MIGHT BE CONCERNED ABOUT, YOU KNOW, LIKE I SAY, WHAT'S HAPPENING AROUND THE PARK DISTRICT OR WITHIN THEIR COMMUNITIES. SOME OF THESE ARE, YOU KNOW, RANGE FROM HOUSING PROJECTS, BUT ALSO A LOT OF THE BIG INFRASTRUCTURE DEVELOPMENT PROJECTS, SOME OF THE WORK ON THE DELTA IS A GOOD EXAMPLE. WE RECENTLY BROUGHT FORWARD AN AGREEMENT AROUND DUTCH SLOUGH THAT KIND OF CAME OUT OF THIS PROCESS. AND THEN WE HAVE THESE ONGOING PARTNERSHIPS WITH LIKE THE COUNTY, EAST CONTRA COSTA COUNTY HABITAT CONSERVANCY IS A GOOD EXAMPLE WHERE THEY'RE, YOU KNOW, ACTIVELY PERMITTING DEVELOPMENT. AND WE HELP IMPLEMENT A LOT OF THAT. AND THEN THERE'S A DIRECT COORDINATION WITH OUR PARTNERS OVER IN GOVERNMENT AND LEGISLATIVE AFFAIRS BECAUSE THESE WILL ALSO BE OFTEN BE TOPICS OF INTEREST AS THEY'RE MEETING OR AS YOU´RE MEETING WITH LOCAL ELECTED LEADERS AS PART OF THE LOCAL GOVERNMENT ENGAGEMENT PROGRAM, OR IF THEY'RE MEETING WITH ELECTED OFFICIALS AT THE STATE LEVEL OR OTHERS. AND THERE'S SORT OF A DIRECT TIE IN WHERE WE'RE ABLE TO PROVIDE THEM SOME INFORMATION AND WE CAN CONTINUE THERE. SO THIS IS JUST KIND OF A SORT OF SKETCH OF THE PROCESS. LIKE I SAY, WE'LL RECEIVE THESE AGENDAS. WE'LL KIND OF ENGAGE. IT'S COMMON FOR A LOT OF THESE PROJECTS TO JUST GO THROUGH SORT OF LONG LULLS OF TIME. PERHAPS THEY'RE INCLUDING SOME OF OUR TRAILS WITHIN THEIR PROJECT SITE. THEY NEED SOME, YOU KNOW, WHETHER THERE'S MANAGEMENT THERE. SO THERE'S OFTEN A TWO WAY CONVERSATION ABOUT SORT OF WHAT THE BALANCE IS THERE. AND THEN ULTIMATELY SOME OF THE STUFF WILL COME OVER TO OUR LAND ACQUISITION DEPARTMENT IN TERMS OF HOW WE INTEGRATE THIS INTO THE PARK DISTRICT AND EVENTUALLY OPERATE IT AND MAKE IT ALL ACCESSIBLE TO THE PUBLIC. SO JUST A COUPLE REPRESENTATIVE EXAMPLES. AND I'M HAPPY TO TAKE ANY QUESTIONS ON, YOU KNOW, ANYTHING ELSE THAT'S SORT OF GOING AROUND. THE AREA IN BLUE AND YELLOW WAS I THINK IT WAS ABOUT 70 ACRES OR SO LOCATED ADJACENT TO LAS TRAMPAS REGIONAL WILDERNESS. SO THIS IS IN THAT SOUTHERN LAS TRAMPAS AREA. IT ACTUALLY CONNECTS TO THE COMMUNITY OF DANVILLE. SO THIS IS WHAT'S PRETTY COMMON FOR A LOT OF OUR LANDS IS THERE WAS A LITTLE BIT OF FLAT AREA THAT WAS DEVELOPABLE, AND THEN IT GOT REALLY STEEP. AND THIS WAS A OLD RANCH. AND A DEVELOPER CAME IN WITH PROPOSALS TO DEVELOP A RELATIVELY SMALL PROJECT. I THINK THIS ONE WAS AROUND 20 HOMES OR SO ON THE FLAT AREAS. BUT THEN RETAINING THE UPPER LANDS FOR OPEN SPACE, AND THE DEVELOPER CAME TO THE PARK DISTRICT AND ASKED IF WE WOULD BE INTERESTED IN TAKING ON THAT LAND IN PERPETUITY. YOU KNOW, TRADITIONALLY, I THINK THE PARK DISTRICT, WE WOULD SAY, YEAH, FREE LAND. THAT SOUNDS GREAT. WE'VE GOTTEN PRETTY SOPHISTICATED ABOUT THIS AND THAT. WE KIND OF RECOGNIZE THERE'S NO SUCH THING AS FREE LAND. ALL OF THIS COMES WITH A MANAGEMENT AND OPERATIONS COST. THERE'S FIRE CONCERNS. AND IN THIS CASE, A LOT OF THE LAND WAS ENCUMBERED WITH A CONSERVATION EASEMENT. SO THAT'S SOMETHING THAT WE HAVE TO CONTINUE TO MANAGE IN PERPETUITY AND MAKE SURE THAT CONSERVATION VALUES ARE KEPT TO THE STANDARDS THAT ARE NEEDED. AND THERE'S SOME FUNDING THAT COMES ALONG WITH THAT. AND ULTIMATELY WE NOW OWN THE PROPERTY. IT'S OPEN TO THE PUBLIC. THERE'S SOME PARKING ALONG THE STREETS THERE. THE HOUSING IS BUILT AND OCCUPIED. BUT THIS WAS GOING ON FOR A GOOD 10 TO 15 YEARS OR SO AS IT WENT THROUGH THE CEQA PROCESS. BUT ULTIMATELY WE GOT A TRAIL DEVELOPED AND SOME PARKING AND NEW OPEN SPACE AND A CONNECTION TO DANVILLE FROM IT. THE LEICESTER PROPERTY. THIS IS AN ACTIVE PROJECT. THIS IS IN DIRECTOR WAESPI'S WARD. JUST BARELY, IT'S OVER ON THE EDGE OF PLEASANTON. THIS IS AN AREA THAT'S LOCATED OUTSIDE OF THE PLEASANTON CITY LIMITS. BUT THE PROPOSAL IS TO ANNEX THE PROPERTY INTO THE CITY OF PLEASANTON. I THINK THERE'S SOME 60 HOMES OR SO PROPOSED JUST FOR ORIENTATION. THE RED LINE HERE IS 580 DUBLIN CANYON ROAD GOES THROUGH THERE. SO THIS IS PLEASANTON RIDGE. SO THERE'S BEEN A LONG STANDING PROPOSAL TO HAVE A CONNECTION GOING DOWN THROUGH THIS AREA. BUT THIS ONE PRIVATE PROPERTY THAT'S BEEN PROPOSED FOR DEVELOPMENT THERE HAS BEEN THERE. SO THE PROJECT PROPOSES TO DEVELOP US A NEW STAGING AREA THAT WILL PROVIDE ACCESS TO SOME OF THE TRAILS THAT WE'RE CURRENTLY BUILDING IN PLEASANTON RIDGE. SO SOME OF THE TRAIL PLANNING THAT'S BEEN DONE IN PLEASANTON RIDGE HAS BEEN DONE WITH THE IDEA THAT EVENTUALLY THIS PROJECT WOULD COME FORWARD AND THERE WOULD BE A CONNECTION THERE. SO WE'RE STILL VERY MUCH IN CONVERSATIONS THERE. THIS IS STILL VERY MUCH IN THE REALM OF THE CITY OF PLEASANTON AS THE LOCAL LAND USE AUTHORITY. [00:25:03] THEY HAVE APPROVAL OF THE PROJECT. THEY'RE GOING THROUGH A CEQA PROCESS. YOU KNOW, THERE MIGHT BE ANY NUMBER OF PUBLIC CONCERNS OR SUPPORT FOR THE PROJECT. WE'RE REALLY KIND OF AGNOSTIC TO WHETHER THE PROJECT'S A GOOD PROJECT OR NOT. A GOOD PROJECT. IT'S REALLY ABOUT ADDRESSING THE DIRECT IMPACTS TO THE PARK DISTRICT, AS WELL AS IDENTIFYING OPPORTUNITIES TO EXPAND ACCESS. SO THIS IS A PROJECT WHERE WE FEEL THERE'S A GOOD OPPORTUNITY FOR SOME PROTECTED OPEN SPACE HERE. AND NEW STAGING AREA ACCESS. AND THEN LIKE I SAY, WE'LL LEAVE THE HOUSING DECISIONS TO THE CITY OF PLEASANTON. AND I SHOULD JUST MENTION, BECAUSE THIS QUESTION CAME UP THE OTHER DAY ABOUT, YOU KNOW, SORT OF THE PARK DISTRICT AND HOUSING IS MOST ALL OF THESE PROJECTS, THERE'S BEEN VERY FEW OF THESE PROJECTS THAT WE HAVE ENGAGED IN THAT ARE ACTUALLY LOCATED WITHIN THE CITY LIMITS OR WITHIN THE URBAN LIMIT LINES. SO THESE ARE OFTEN, YOU KNOW, THE PARK DISTRICT GENERALLY ACQUIRES OR ENGAGES IN PROJECTS THAT ARE CONSIDERED, YOU KNOW, ON LANDS THAT ARE HAVE NOT BEEN SLATED FOR DEVELOPMENT. SO THIS IS A PROJECT WHERE THEY'RE PROPOSING THE EXPANSION OF THE CITY LIMITS, TO ACTUALLY BRING THIS INTO THE AREA. SO ANOTHER GOOD EXAMPLE IS THE EAST CONTRA COSTA COUNTY HABITAT CONSERVANCY. I THINK, YOU KNOW, WE'RE ALL FAMILIAR WITH THIS, BUT THIS WAS A PRETTY INNOVATIVE AND SUCCESSFUL PROPOSAL WHEN IT WAS ACTUALLY ADOPTED IN 2008. AND AT THAT TIME THERE AND STILL, THERE'S A LOT OF GROWTH IN PITTSBURG, ANTIOCH AND OAKLEY AND DISCOVERY BAY AND BRENTWOOD. ACTUALLY, ANTIOCH IS NOT A PARTY TO THE HABITAT CONSERVATION PLAN. BUT BASICALLY WHAT THIS PLAN DID WAS, YOU KNOW, IT ALLOWED FOR A STREAMLINED, PERMITTING STRUCTURE FOR HOUSING DEVELOPMENT TO MOVE FORWARD WITHIN THE DEVELOPMENT FOOTPRINT OF THE COMMUNITIES OF PITTSBURG AND OAKLEY AND BRENTWOOD AND THEN EXCHANGE FOR SORT OF THAT STREAMLINED DEVELOPMENT THEY WOULD PAY IMPACT FEES THAT THEN NOW WE WORK WITH THE COUNTY CONSERVANCY TO ACQUIRE AND PRESERVE LAND THERE. SO IT KIND OF DREW A LINE SAYING, YOU KNOW, DEVELOPMENT IS OKAY IN HERE AND OVER IN THIS AREA IS WHERE WE'RE GOING TO PRESERVE AND PROTECT AREAS. SO I THINK YOU ALL KNOW WE'VE BEEN PRETTY SUCCESSFUL WITH THIS. I'VE ACQUIRED A NEARLY 15,000 ACRES THROUGH THIS PROCESS. 42 PROPERTIES IN TOTAL. THE HABITAT CONSERVANCY IS GOING TO BE COMING UP FOR A RENEWAL OF THEIR PERMIT SOON TO PROVIDE AN EXTENSION OF THAT. REALLY, THE DEVELOPMENT ACTIVITY IN PITTSBURG AND ANTIOCH HASN'T REALLY KEPT UP WITH THE LAW OF THE LAND CONSERVATION THERE. SO THEY'RE LOOKING TO EXTEND THAT PERMIT TERM. SO THAT'S SOMETHING THAT I'LL BE COMING BACK TO THE BOARD AT SOME TIME, AND I IMAGINE WE'LL BE HAVING A NUMBER OF CONVERSATIONS ABOUT WHAT THAT MEANS, BECAUSE WE ARE THE IMPLEMENTING AGENCY ON THAT AGREEMENT. SO WE'LL BE DIRECTLY INVOLVED IN THAT. AND THEN JUST LASTLY, ANOTHER GOOD EXAMPLE HERE OF THE CONCORD NAVAL WEAPONS STATION, WHICH CLOSED BACK IN 2005. A LONG COMMUNITY PROCESS THAT PURSUED ABOUT JUST WHAT THE BALANCE OF HOUSING VERSUS OPEN SPACE ON THAT PROPERTY WAS GOING TO BE. THE PARK DISTRICT WAS VERY INVOLVED IN THAT FROM THE BEGINNING. AND ULTIMATELY, YOU KNOW, A PLAN WAS ADOPTED THAT HAD PRETTY BROAD SUPPORT, A PLAN FOR 13,000 NEW HOMES. AND THERE WAS NOT A SINGLE CEQA CHALLENGE ON THAT, WHICH WAS PRETTY INCREDIBLE. AND THEN AND OF COURSE, WE'VE SEEN NOW OUR PARK PLANS CONTINUE TO MOVE FORWARD. WE'RE IMPLEMENTING THE SOUTH OF BAILEY ROAD PROJECT TO PROVIDE PUBLIC ACCESS DOWN IN THAT AREA. AND THE CITY CONTINUES TO SORT OF WORK THROUGH WHATEVER CHALLENGES THEY HAVE ON THE CITY SIDE TOWARDS MOVING TOWARDS DEVELOPMENT. SO THAT'S SOMETHING THAT WE CONTINUE TO ENGAGE IN. SO THIS IS, LIKE I SAY, A BODY OF WORK THAT ISN'T ALWAYS REALLY EVIDENT TO FOLKS, BECAUSE A LOT OF THIS HAPPENS, YOU KNOW, IT'S US GOING TO OTHER AGENCIES. IT WAS $349 BILLION, ABOUT $29 BILLION ABOVE WHERE IT WAS LAST YEAR. THERE IS SOME DEBATE ABOUT THE AMOUNT OF DEFICIT THE STATE MAY BE INCURRING. THE GOVERNOR'S ESTIMATING AT ABOUT $2.9 BILLION. THE LEGISLATIVE ANALYST'S OFFICE IS ESTIMATING AROUND $18 BILLION. AND SO THERE WILL BE CONTINUED NEGOTIATION, AS IS EVERY YEAR. THE GOVERNOR WILL RELEASE THEIR BUDGET AND THEN IT WILL GO TO THE LEGISLATURE AND THERE'LL BE A REVISION IN MAY AND FINAL ADOPTION IN JUNE. NOTABLE, THERE WAS A BIT OF A SHIFT IN GREENHOUSE GAS REDUCTION FUND ALLOCATIONS. THERE HAD BEEN PROPOSED $1 BILLION OF THAT FUNDING, WHICH IS ABOUT $4 BILLION A YEAR FOR DISCRETIONARY DECISIONS BY THE LEGISLATURE. BECAUSE THERE IS A DEFICIT THAT $1 BILLION IS ACTUALLY GOING TO BE SHIFTED TO CAL FIRE TO COVER BACKFILL SOME OF THEIR FUNDING. SO THAT WILL BE ALSO A NEGOTIATION WITH THE STATE LEGISLATURE AND THE GOVERNOR. AND THEN NOTABLE FOR THE PARK DISTRICT, IT WAS A $33 MILLION ALLOCATION IN PROP 4 TO THE COASTAL CONSERVANCY FOR COASTAL RESILIENCE, AND ANOTHER $110 MILLION TO THE WILDLIFE CONSERVATION BOARD FOR NATURAL HABITAT RESTORATION AND PROTECTION. SO WITH THAT, KIND OF A HIGH LEVEL OVERVIEW OF WHERE THE BUDGET PROCESS IS RIGHT NOW. OH, AND I SHOULD ADD THAT THE GOVERNOR IS PROPOSING TO MAKE UP THE ROUGHLY $3 BILLION DEFICIT WITH A REDUCTION IN STATE OPERATIONS, WHICH ESSENTIALLY MEANS NOT FILLING ABOUT 6000 POSITIONS THAT ARE CURRENTLY OPEN. BUT WITH THAT, I'D LIKE TO INTRODUCE REED ADDIS, WHO IS OUR CONSULTANT AT EEC, ENERGY AND ENVIRONMENT CONSULTING IN SACRAMENTO TO GIVE A LITTLE BIT MORE CONTEXT OF WHERE WE ARE, NOT JUST WITH THE BUDGET PROCESS, BUT, YOU KNOW, THERE'S BEEN A LOT GOING ON IN THE STATE SINCE PROP 50 PASSED. WE HAVE A NEW LEADER IN THE SENATE FROM SOUTHERN CALIFORNIA, FROM THE SANTA BARBARA REGION, [00:45:02] AND SHE HAS APPOINTED TWO IMPORTANT BUDGET POSITIONS. BUT I DO KNOW THERE WERE CHANGES IN THE SENATE TO BOTH THE ULTIMATE LEADERSHIP BUT ALSO IN THE BUDGET THAT YOU SHOULD ALL BE AWARE OF AND THAT WE'RE TAKING INTO ACCOUNT AS WE THINK THROUGH THE WORK WE NEED TO DO FOR YOU. HAVING SAID THAT, AS ERIC SET UP, THIS IS AN ELECTION YEAR AND WE KNOW THIS IS THE LAST YEAR FOR THE GOVERNOR. SO WHAT TENDS TO HAPPEN IS PEOPLE WHO ARE IN THE ADMINISTRATION, IF A JOB OFFER COMES ALONG, THEY MIGHT TAKE IT. SO WE DO ANTICIPATE THAT AS THE MONTHS GO BY, SOME OF THOSE PEOPLE WE TRADITIONALLY WILL WORK WITH AND TALK TO AND TRY TO ADVOCATE WITH WHEN IT RELATES TO THE BUDGET, THEY MAY LEAVE AND WE MAY HAVE NEW STAFF THAT WILL HAVE TO DEAL WITH. SO FROM A WHO IS IN CHARGE OF THE BUDGET, A LOT OF THE SAME PEOPLE IN THE ASSEMBLY TODAY, IT'S THE SAME PEOPLE IN THE GOVERNOR´S OFFICE. BUT WE ANTICIPATE THERE DEFINITELY COULD BE CHANGES. AND THEN DEFINITELY THERE WERE CHANGES IN THE SENATE. THEN THERE'S THE QUESTION OF WHAT IS IN THE BUDGET AND WHAT DO WE CARE ABOUT. AND ERICH TALKED ABOUT TWO OF THOSE REALLY IMPORTANT ITEMS. ONE IS PROP 4, WHERE FOR THE MOST PART, WE DO SEE THE DOLLARS THAT THE GOVERNOR HAS PUT IN HIS PROPOSED BUDGET BEING ACCEPTABLE. WE ARE HAVING CONVERSATIONS WITH YOUR TEAM RIGHT NOW ABOUT WHETHER WE WE BELIEVE THERE SHOULD BE SOME ADJUSTMENTS TO THAT. OBVIOUSLY, IF WE ALL FEEL THAT THERE MAY BE ADJUSTMENTS UP, I GUESS THERE COULD BE ADJUSTMENTS DOWN. BUT MY GUESS IS MAYBE SOME ADJUSTMENTS UP TO HOW MANY DOLLARS AT A CERTAIN AGENCY. WE WILL OVER THE NEXT THREE, 4 OR 5 MONTHS, BE ABLE TO GO TALK TO THE BUDGET COMMITTEES IN THE LEGISLATURE AND TRY TO ASK FOR THOSE CHANGES. THAT'S FOR PROP 4 THE OTHER IMPORTANT ELEMENT OF PROP 4. EVEN THOUGH WE ARE NOW TALKING ABOUT THE SECOND FISCAL YEAR OF TRYING TO APPROPRIATE PROP 4 MONEY. WE HAVE HAD A GLITCH IN THE FIRST YEAR. AND THERE WAS IF YOU'LL RECALL IN THE LAST COUPLE OF MEETINGS, WE DID TALK ABOUT THIS THIS ISSUE THAT WAS NOT ORIGINALLY ADDRESSED IN PROP 4 AND WAS NOT FIXED IN THE BUDGET PROCESS LAST YEAR. AND THAT IS CORRECTING SOME OF THE LANGUAGE IN PROP 4 TO ALLOW FOR GUIDELINES TO CLEARLY BE USED BY THE STATE AGENCIES VERSUS THE FULL BLOWN REGULATORY PROCESS. WE IT IS NOW CLEAR THAT WE NEED THAT FIX, AND WE NEED THAT FIX URGENTLY. MANY OF THE AGENCIES, INCLUDING THE AGENCIES YOU CARE ABOUT, HAVE NOT BEEN ABLE TO GET APPROVAL. THEY HAVE NOT BEEN ABLE TO GET THEIR GUIDELINES APPROVED, WHICH MEANS THEY ARE NOT IN A POSITION TO BE ABLE TO START OFFERING DOLLARS IN THE FORM OF GRANTS AND SOLICITATIONS. SO WE'RE WORKING WITH THE LEGISLATURE INCLUDING ASSEMBLY MEMBER ALVAREZ FROM THE SAN DIEGO REGION, WHO'S INTRODUCED AB 35, WHICH IS HIS VEHICLE, HIS PIECE OF LEGISLATION THAT WOULD TRY TO MAKE THIS FIX RELATED TO GUIDELINES AND PROVIDE CLARITY TO AGENCIES. THEY CAN DO THE TRADITIONAL GUIDELINES THAT THEY'VE DONE IN PAST BONDS. THERE'S AN URGENCY CLAUSE IN THERE AND SO FAR, MOVING THAT BILL THROUGH THE PROCESS, WE'VE WE'VE BEEN ABLE TO EXPEDITE IT AND HAVE [00:50:08] BIPARTISAN SUPPORT. OUR GOAL, IF WE'RE SUCCESSFUL, IS TO GET THAT MEASURE SIGNED BY THE GOVERNOR BEFORE THE COASTAL CONSERVANCY BOARD MEETING ON FEBRUARY 19TH. SO WE'LL SEE. WE ARE DOING EVERYTHING WE CAN TO GET THAT PIECE OF LEGISLATION SOLVED. THE VALUE OF GETTING THAT LEGISLATION SOLVED OR PASSED, IF YOU WILL, IS TO ALLOW THESE VERY IMPORTANT PROP $4 TO START FLOWING OUT OF THE STATE AGENCIES, MANY OF THE STATE AGENCIES, AGAIN, THAT YOU AND YOUR TEAM ARE LOOKING AT TO TRY TO PULL DOLLARS DOWN FOR YOUR IMPORTANT PROJECTS. THE OTHER THING THAT I'LL JUST I WON'T GO INTO TOO MUCH DEPTH RIGHT NOW, BUT HAPPY TO ANSWER ANY QUESTIONS. WE REALLY HAD SPENT ALMOST TWO YEARS FOCUSED ON TRYING TO GET THE STATE'S CLIMATE PROGRAM TO HAVE FUNDING AVAILABLE FOR NATURAL RESOURCE PROJECTS. WE WELL, NOT 100% SUCCESSFUL IN MEETING OUR GOALS. THIS LAST YEAR WE GOT CLOSE IN THAT WE MOVED THE NEEDLE AND MADE IT VERY CLEAR WITHIN THE VARIOUS LAWS THAT THESE CLIMATE DOLLARS, SOMETIMES I REFER TO THEM AS THE GRF DOLLARS, CAN BE USED FOR NATURAL RESOURCES. WE WERE ABLE TO GET THAT INTO LAW. SO WHEN WE MOVED INTO JANUARY, WE WERE ASSUMING AT SOME POINT IN THE BUDGET PROCESS, WE'D BE ABLE TO TALK ABOUT TAKING SOME OF THOSE CLIMATE DOLLARS AND USING THEM FOR NATURAL RESOURCE PROJECTS. UNFORTUNATELY, AS YOU HEARD ERIC MENTIONED A MOMENT AGO, A COMBINATION OF HOW THE DEPARTMENT OF FINANCE IS INTERPRETING HOW THE MONEY SHOULD FLOW AND SOME PROJECTIONS BY THE AIR RESOURCES BOARD, WHO GETS TO KIND OF DECIDE HOW MUCH MONEY THEY THINK WILL BE COMING IN TO THIS PROGRAM. A COMBINATION OF THOSE DYNAMICS HAS LED TO CONCERNS THAT THERE MAY NOT BE MONEY IN THIS YEAR'S BUDGET FROM THE CLIMATE PROGRAM FOR NATURAL RESOURCES. SO WE'RE GOING TO BE MONITORING THIS AND BRINGING THAT INFORMATION BACK TO YOU OFTEN ABOUT WHAT'S GOING ON. AND MY HOPE IS THAT IN A COUPLE OF MONTHS, I HAVE A VERY DIFFERENT UPDATE FOR YOU AND THAT WE WERE SUCCESSFUL IN GETTING SOME MONEY FOR NATURAL RESOURCES. BUT AS OF TODAY, I'M A LITTLE PESSIMISTIC, GIVEN WHAT WE'VE BEEN HEARING FROM THE GOVERNOR´S OFFICE AND FROM THE AIR RESOURCES BOARD. FINALLY, I'LL JUST CLOSE OUT BY SAYING THE DYNAMICS OF AN ELECTION YEAR, THE LAST YEAR OF THE GOVERNOR WILL PROBABLY IMPACT OUR WORK IN WAYS THAT WE CAN'T SEE YET. AND WHAT I MEAN BY THAT IS MANY TIMES AN ELECTED OFFICIAL DURING AN ELECTION YEAR WILL BE SUPER CONSERVATIVE AND SENSITIVE TO MAYBE THEIR VOTES AND WHAT THEY'RE PROMOTING. SO WE'RE GOING TO SEE A LITTLE BIT OF THAT GOING ON. WE'RE DEFINITELY GOING TO BE SEEING AS MANY OF YOU, I'M SURE, ARE WATCHING PEOPLE WHO ARE LINING UP TO BE THE NEXT GOVERNOR. AND THIS JUNE WILL BE THE PRIMARY. WE'RE GOING TO SEE WHO TAKES THE TOP TWO POSITIONS. AND ONCE THAT HAPPENS, YOU CAN IMAGINE THE TYPES OF CONVERSATIONS GOING ON IN SACRAMENTO RELATED TO WHO THE NEXT GOVERNOR MIGHT BE AND HOW TO START PROGRAMING AND POSITIONING FOR THAT NEW GOVERNOR. IT'LL TAKE A LOT OF OXYGEN OUT OF THE ROOM, AND IT'LL DEFINITELY IMPACT THE CURRENT GOVERNOR'S WORK. AND THEN FINALLY, YOU'VE HEARD US MENTION THIS MANY TIMES IN THE PAST, AND YOU'RE ALL WELL AWARE OF IT IN READING THE NEWSPAPER EVERY DAY. THIS GOVERNOR INCREASINGLY IS FOCUSED ON WHAT HIS NEXT GIG MIGHT BE. AND HOW IS HE POSITIONING HIMSELF AND WHAT BILLS AND LAWS IS HE PROMOTING? AND THAT TENSION OR FOCUS MAYBE I THINK WILL INCREASE AS HE'S LOOKING AT ACTIVITY BEYOND THIS YEAR. AND SO ALL OF THOSE FACTORS WILL PLAY INTO HOW THE LEGISLATURE IS GOING TO BEHAVE, HOW THE GOVERNOR IS GOING TO BEHAVE, HOW THAT MIGHT IMPACT DOLLARS FLOWING, HOW THAT MIGHT IMPACT THE BUDGET. OBVIOUSLY, IT'LL PROBABLY ALSO IMPACT LEGISLATIVE PROCESSES. AND I THINK WITH THAT I MIGHT PAUSE. THERE'S DIFFERENT INTERPRETATIONS OF WHAT THE PROBLEMS ARE WITH THE ECONOMY, WHICH THUS RELATES TO TAXPAYER RECEIPTS. AND SO, GOING INTO THIS LEGISLATIVE SESSION, WE'RE REALLY GOING TO BE FOCUSING ON ACTIVATING THE EAST BAY HILLS CONSERVATION PROGRAM AND WORKING WITH OUR DELEGATION TO UNDERSTAND AND DRIVE FUNDING TOWARDS THAT PROGRAM. IT WAS PRETTY SMALL TEXT, BUT YOU MIGHT HAVE SEEN IN THE BUDGET REVIEW DOCUMENT THAT THE COYOTE VALLEY PROGRAM, WHICH THIS LEGISLATION IS BASED OFF OF, RECEIVED $14 MILLION THROUGH THE BOND. AND BY WAY OF REMINDER, BY DRIVING FUNDING TOWARDS THAT AREA, IT DOESN'T TAKE AWAY FROM OTHER AREAS OF THE PARK DISTRICT, BUT IT ALLOWS US TO INVEST GENERAL FUNDS OR OTHER PRIORITY FUNDS TOWARDS OTHER REGIONS OF THE PARK DISTRICT AND UTILIZE STATE FUNDING FOR THE EAST BAY HILLS, SO I DO NOT PLAN TO SPONSOR A SPECIFIC PARK DISTRICT BILL COMING INTO THIS YEAR, BUT WE ARE PLANNING TO MEET WITH OUR PARTNERS AT MIDPENINSULA REGIONAL OPEN SPACE AUTHORITY, SAVE THE BAY AND OTHERS TO SEE WHAT THEY PLAN TO BE INTRODUCING AND PROVIDE OUR SUPPORT IN TIME ON THOSE BILLS AS WELL.
