I WANTED TO JUST START BY SAYING, YOU KNOW, THE THIS ITEM CAME OUT OF THE PRIORITY SESSION WITH YOUR BOARD. 1 THING WE HEARD FROM, I THINK ALMOST ALL THE BOARD MEMBERS WAS IN INTEREST IN OPENING DOOLAN CANYON. AND SO FOLLOWING UP WITH THAT, WE HAD A SITE VISIT ON A VERY HOT DAY AND BUT IT WAS REALLY COOL TO GET OUT THERE AND SEE THE SITE TOGETHER. AND AND THEN OUR TEAM HAS BEEN OUR PLANNING TEAM, AND I WANT TO APPRECIATE DRAKE HERE, WHO'S GOING TO PRESENT, BUT ALSO NAOMI AND BRIAN FOR THEIR LEADERSHIP. THEY'VE BEEN WORKING WITH ALL OF OUR INTERNAL TEAMS, OUR STEWARDSHIP TEAM, THE GRAZING TEAM, THE OPERATIONS FOLKS, OUR PROJECTS TEAM TO KIND OF MAP OUT, OKAY, WHAT ARE THE RANGE OF OPTIONS THAT WE COULD APPROACH THIS PROPERTY WITH? AND YOU KNOW, THE BOARD HAS MADE KIND OF OPENING LAND BANK PROPERTIES IN GENERAL A RECENT PRIORITY, AND DOOLAN CANYON IN PARTICULAR. SO THIS IS KIND OF LIKE JUST AN EXTENSION OF THAT EFFORT AND SPECIFICALLY THE THE BOARD PRIORITY SETTING SESSION THAT SET DOOLAN CANYON AS A PRIORITY. SO BEFORE WE GET INTO THIS, I JUST WANT TO DO A QUICK AGENDA BECAUSE IT'S A BIT OF A LONG PRESENTATION. SO JUST KIND OF GIVE US A ROADMAP. FIRST, WE'LL GET INTO THE DOOLAN CANYON PROPERTY BACKGROUND AND CONSERVATION EASEMENT BACKGROUND THAT'S GOING TO BE RECORDED ON THE SITE. THEN WE'LL GO OVER SURROUNDING PROPERTY USES AND CONSTRAINTS. AND FINALLY WE'LL GET TO THE PUBLIC ACCESS STRATEGIES. THE RECOMMENDATION WE ARE MAKING TODAY IS THE GENERAL MANAGER RECOMMENDS THAT THE EXECUTIVE COMMITTEE PROVIDE STAFF WITH FEEDBACK AS IT WORKS TO ASSESS SCOPE AND COSTS OF IMPLEMENTING PARK IMPROVEMENTS ON LAND TO BE ACQUIRED FROM THE CITY OF LIVERMORE, AND ENGAGE PARTNER ORGANIZATIONS TO LEAD TOURS INTO DOOLAN CANYON REGIONAL PRESERVE AND TO BRING A PROPOSAL TO THE FULL BOARD OF DIRECTORS. SO 1ST, I'M GOING TO START WITH THE DOOLAN CANYON ACQUISITION. ACQUISITION TIMELINE. FROM 2007 TO 2010, THE PARK DISTRICT PARTICIPATED IN THE EAST ALAMEDA COUNTY CONSERVATION STRATEGY. OR EACCS THIS WAS JUST KIND OF A LARGER EFFORT TO JUST COORDINATE CONSERVATION OUT THERE BETWEEN A LOT OF DIFFERENT AGENCIES, JUST KIND OF LIKE SET PRIORITIES, KIND OF TRY TO STREAMLINE PERMITTING. AND IN THAT VEIN AND IN THAT, WITH THAT IN CONSIDERATION, THE PARK DISTRICT ENTERED INTO A MEMORANDUM OF AGREEMENT WITH THE CITY OF LIVERMORE TO PURCHASE DOOLAN CANYON. IN 2010, LIVERMORE PROVIDED $2 MILLION TOWARDS THE PURCHASE OF THAT PROPERTY. AND THAT WAS THE 6:40 ACRE SOUTHERN SCHMIDT'S PROPERTY. JUST THE LARGER SQUARE ON THE SOUTH THERE. IN 2000 AND IN 2010, WE WE OFFICIALLY. I'M SORRY I SKIPPED AHEAD THERE. SO 2010 WAS THE SCHMIDT'S PROPERTY. IN 2018, WE DID THE GROVE PROPERTY, WHICH WAS KIND OF ADDING THAT NORTHERN PANHANDLE TO THE PARK. AND THAT WAS AN ADDITIONAL 160 ACRES. AND THEN WE ALSO HAVE AN ONGOING DISCUSSION CURRENTLY ONGOING, TO PURCHASE THE CITY OF LIVERMORE ACQUISITION PROPERTY, WHICH YOU CAN SEE IT'S KIND OF SMALL UP THERE, I APOLOGIZE. IT'S THAT ORANGE 1 DOWN TO THE SOUTH. IT'S ABOUT HALF A MILE SOUTH OF DOOLAN CANYON PROPER, ALONG DOOLAN ROAD. AND THEN AS FAR AS THE CONSERVATION EASEMENT, WE THIS PURCHASE WITH LIVERMORE WAS WITH THE UNDERSTANDING THAT LIVERMORE WOULD BE ABLE TO TO RECORD A CONSERVATION EASEMENT ON THE PROPERTY FOR TO SERVE AS MITIGATION FOR DEVELOPMENT PROJECTS IN LIVERMORE. INITIALLY IN 2008 WAS JUST 2 PROJECTS. AND THEN A THIRD PROJECT WAS ADDED IN 2012. [00:15:08] AND IN 2025, A WE TOOK ALL THREE MOAS FROM THE PREVIOUS CONSERVATION EASEMENTS, COMBINED THEM INTO A NEW OMNIBUS THAT WAS APPROVED BY THE BOARD OF DIRECTORS. AND THAT KIND OF KIND OF HELPED UPDATE THE TERMS OF THOSE MOAS TO, TO DEPICT WHAT THE ONGOING AND NEW NEW CONSIDERATIONS OF THOSE WERE AND THE CONSERVATION EASEMENT. SO IN TOTAL, IT WILL BE A 211 ACRE MITIGATION CONSERVATION EASEMENT ON THE SOUTHEAST CORNER OF THE PROPERTY. TRI VALLEY CONSERVANCY WILL HOLD THE CONSERVATION EASEMENT AND THE ENDOWMENT, WHICH THE PARK DISTRICT WILL THEN BILL FOR CONSERVATION EASEMENT WORK, AND THE PARK DISTRICT WILL BE THE PRESERVE MANAGER DOING THE WORK OUT THERE. JUST TO GIVE A LITTLE MORE DETAILS ON THE MITIGATION, IT WAS FOR 3 DIFFERENT PROJECTS. THE FIRST 2 WERE THE ISABEL AVENUE I-580 INTERCHANGE AND THE EL CERRITO EL CERRITO SPECIFIC PLAN DEVELOPMENTS. AND THEN THE 1 THAT WAS ADDED LATER WAS THE LIVERMORE TOYOTA DEALERSHIP MITIGATION, WHICH ADDED 8.3 ACRES TO THE TOTAL MITIGATION AREA AND ADDED ABOUT $140,000 OF ADDITIONAL FUNDING FOR THE ENDOWMENT. SO I JUST WANTED TO GIVE AN OVERVIEW OF THE LIVERMORE ACQUISITION PROPERTY. THAT 1 WAS THE LITTLE HALF A MILE SOUTH OF DOOLAN CANYON PROPER. IT WAS A THE THE OVERALL PROPERTY WAS PURCHASED BY THE CITY OF LIVERMORE TO SERVE AS ADDITIONAL MITIGATION FOR DIFFERENT PROJECTS IN THE AREA, AND AS PARK DISTRICT AGREED TO PURCHASE 4.53 ACRES ALONG THE DOOLAN ROAD AND THE. IT'S THE SITE OF THE FORMER RESIDENCE THAT WAS ON THAT PROPERTY. SO THERE'S A BARN, AN UNPERMITTED RESIDENCE, AND VARIOUS OUTBUILDINGS. THERE IS ELECTRICITY AND A SEPTIC TANK, BUT THE SEPTIC TANK HAS WE NEED TO LOOK INTO WHETHER THAT'S ACTUALLY A USABLE SEPTIC TANK. WE'RE NOT SURE. IT MAY BE UNPERMITTED. WE DON'T REALLY KNOW THE STATUS OF THAT YET, BUT IT'S A CONSIDERATION FOR FUTURE DEVELOPMENT OF THE SITE THAT THERE COULD BE A SEPTIC TANK THERE. THERE'S ALSO A WATER WELL ON THE PART OF THE PROPERTY THAT LIVERMORE WILL BE RETAINING, SO WE WON'T HAVE OWNERSHIP OF THAT WATER WELL FOR WATER ON THE PROPERTY. BUT OUR LAND DEPARTMENT IS IN DISCUSSIONS WITH THE CITY OF LIVERMORE TO PIPE THE WATER OVER TO OUR PROPERTY AS WELL, BUT THAT HASN'T YET BEEN AGREED TO. SO, BUT SO, BUT IT'S DEFINITELY A FUTURE POSSIBILITY OF THAT LIVERMORE ACQUISITION PROPERTY TO HAVE ALL THESE UTILITIES. SO NOW I WANTED TO TALK ABOUT THE PUBLIC ACCESS OPPORTUNITIES AND CONSTRAINTS OUT THERE. FIRST WE'RE GOING TO START WITH THE CONSTRAINTS. AND THE FIRST OF ALL, THE PROPERTY WAS PURCHASED IN PART AS MITIGATION. THAT WAS THAT WAS GOING BACK TO THAT CONSERVATION STRATEGY I DISCUSSED EARLIER. IT WAS JUST THAT WAS THE MAIN REASON OR ONE OF THE MAIN REASONS WE PURCHASED THAT OUT THERE ORIGINALLY. AND AS SINCE WE'VE SINCE WE'VE BOUGHT IT, YOU CAN SEE ON THIS MAP CONSERVATION EASEMENTS HAVE KIND OF STARTED TO SURROUND THE PARK. IT'S REALLY HIGH CONSERVATION VALUE LAND OUT THERE. THERE'S A LOT OF ENDANGERED SPECIES. SO VARIOUS OTHER CITY OF LIVERMORE, OTHER DEVELOPERS HAVE BEEN BUYING HAVE BEEN BUYING LAND TO RECORD CONSERVATION EASEMENTS OUT THERE. WE DON'T EVEN HAVE ACCESS ALONG THAT DOOLAN ROAD. IT CROSSES INTO THAT BROWN RANCH CONSERVATION EASEMENT, AND WE DON'T HAVE ACCESS RIGHTS THERE, SO WE CAN'T EVEN REALLY ACCESS THAT AS STAFF, LET ALONE FOR PUBLIC ACCESS. AND THE FINAL CONSTRAINT IS THE WEATHER. AS WE ALL SAW IN OUR SITE VISIT OUT THERE, IT WAS EXTREMELY HOT IN THE SUMMER. AND AS SOON AS IT STARTS RAINING, IT'S VERY MUDDY ON THOSE ROADS OUT THERE IN THE WINTER. A PARK STAFF DOESN'T EVEN REALLY LIKE DRIVING THEIR TRUCKS IN THERE, AND THE GRAZER USES AN ATV TO MOVE AROUND THE SITE. ONCE IT STARTS RAINING, JUST BECAUSE IT'S SO, IT'S VERY DIFFICULT. IT'S SO DIFFICULT TO ACCESS IN THE WINTER, BUT THERE ARE ALSO OPPORTUNITIES OUT THERE. THE PARKLAND, THERE'S MUCH OF THE PARK IS NOT UNDER THE CONSERVATION EASEMENT OR THE TO BE RECORDED CONSERVATION EASEMENT. SO WE HAVE DON'T HAVE ANY RECREATION RESTRICTIONS ON AREAS OUTSIDE OF THERE. THE CONSERVATION EASEMENT ALSO ALLOWS PUBLIC ACCESS ON EXISTING ROADS. [00:20:03] SO WE CAN'T WE JUST CAN'T EXPAND THE TRAIL NETWORK IN THAT SOUTHEAST CORNER. AND FINALLY, THE CITY OF LIVERMORE ACQUISITION PROPERTY TO THE SOUTH. LIKE I ALREADY SAID, THERE'S ALL THOSE UTILITIES, POTENTIAL UTILITIES THERE. SO AND WE CAN HAVE OFFER PICNICKING OR OTHER PARKING, PARKING OPPORTUNITIES TO THE SOUTH. SO NOW WE'VE GOTTEN TO THE PUBLIC ACCESS OPTIONS. THE THING THAT EVERYONE HERE IS HERE FOR, I THINK. BUT I JUST WANTED TO ALL THAT CONTEXT KIND OF I THINK WILL HELP ALLOW US TO HAVE A DISCUSSION AND MAKE AN INFORMED DECISION ABOUT WHAT TYPE OF PUBLIC ACCESS IS POSSIBLE OR WANTED AT AT DUELING CANYON. AND WE KIND OF HAVE 2 OPTIONS THERE THAT WOULD BE EITHER MANAGED BY PARK DISTRICT STAFF OR COULD POTENTIALLY BE MANAGED BY A PARTNER TO THE PARK DISTRICT. AND FINALLY, THE LAST OPTION IS JUST OPEN THE SOUTHERN LIVERMORE PROPERTY AS LIKE A PICNICKING SITE FOR PEOPLE TO GO TO AND LEAVE DOOLAN CANYON PROPER CLOSED. AND WE WILL NOW KIND OF GO THROUGH WE WE TALKED WE TALKED TO PARK DISTRICT STAFF IN VARIOUS DEPARTMENTS AND TRIED TO ASSESS COSTS AND DIFFERENT THINGS THAT WOULD WOULD MAKE EACH OF THESE POSSIBLE COSTS TO MAKE EACH OF THESE POSSIBLE. AND THOSE COSTS, ALL THESE FUTURE COSTS. I'M JUST GONNA STOP HERE AND SAY, THESE ARE JUST ESTIMATES FROM PARK DISTRICT STAFF. THEY'RE ALL A LITTLE BIT SQUISHY. BUT WE DID OUR BEST TO COME UP WITH, LIKE, REAL NUMBERS FOR US TO EVALUATE THESE THINGS. SO CURRENTLY OPERATIONS IS SPENDING ABOUT 15 GRAND A YEAR OUT THERE FOR STAFFING AND MAINTENANCE. THAT WOULD BE, YOU KNOW, FENCE REPAIR, TRASH CLEANUP, VARIOUS PATROLS, JUST KIND OF LIKE VISITING THE SITE OCCASIONALLY AND MAKING SURE EVERYTHING'S OKAY OUT THERE. STEWARDSHIP WE HAVE IT IS GRAZED. SO OUR GRAZING PROGRAM DOES HAVE A LOT OF WORK OUT THERE. AND VARIOUS OTHER SUB STEWARDSHIP DEPARTMENTS WILL DO POND SURVEYS OR VARIOUS OTHER THINGS OCCASIONALLY. THE PUBLIC ACCESS WOULD ONLY BE ALLOWED ON EXISTING SERVICE ROADS, AND WE WOULD ALSO RECOMMEND MONITORING PUBLIC ACCESS DURING THE PILOT PROJECT. AND THAT'S JUST DUE TO THE HIGH CONSERVATION VALUE AND THE COST ASSOCIATED WITH THIS. IF WE SEE THERE'S MINIMAL USE OUT THERE, WE CAN MAYBE REVERT TO OPTION 1 SHOULD THERE BE NOT MUCH PUBLIC? PROGRAMS WOULD FOCUS ON THE SPRING WILDFLOWER SEASON, AND THIS PARK WOULD BE SERVED BY THE SEASONAL VISITOR CENTER AND SPRING AND SONOMA IS ALREADY VERY BUSY, SO HAVING OUR PARK DISTRICT STAFF DO THIS WORK COULD POTENTIALLY HAVE IMPACTS ON OTHER PROGRAMS. SHOULD THIS BECOME SOMETHING THAT'S POPULAR? WE DO A LOT. IT JUST COULD KIND OF LIMIT THEIR ABILITY IF WE DO NOT HIRE MORE NATURALISTS OUT THERE. AND I BELIEVE WE HAVE A HISTORY OF BEING VERY, VERY GOOD AT BEING PROTECTIVE OF THE ECOSYSTEMS AND THE HABITAT AND SHEER PRESERVATION OF SENSITIVE LANDS AND OPEN SPACE WHILE ALLOWING [00:35:09] LIMITED PUBLIC ACCESS. WHICH, YOU KNOW, ESPECIALLY IN THAT COMMUNITY, ACCORDING TO THE DEMOGRAPHIC TOOLS WE WERE GIVEN BY BRIAN TO WORK ON THE PLAN WE'RE UNDERUTILIZED IN DUBLIN AND YOU KNOW, VARIOUS AREAS. THAT'S A VERY INTERESTING TOOL THAT WE HAVE THAT MAPS UTILIZATION PER CAPITA OF OUR PARKS. SO I'M SUPPORTIVE OF THE APPROACH THAT YOU FOLKS ARE PRESENTING TO US IN TRYING TO PRESERVE THAT, THAT BALANCE LIMITED PUBLIC ACCESS AND AND PRESERVING THE HABITAT AND ECOSYSTEMS THAT ARE REFLECTED IN WHAT THE LAND WAS ACQUIRED FOR. SO I GET ALL THAT, AND IT'S A GOOD SET OF OPTIONS. SO MY QUESTION IS I WOULDN'T SUPPORT OPTION 1. I SUPPORT OPTION 2, BUT I ALSO SUPPORT OPTION 3 AND B. 3.A AND B AND OPTION 4. AND THEY SPECIFICALLY ASKED WHETHER RESTRICTIONS ON HIKING ONCE YOU GOT IN THE PARK AND THEY SAID, NO, THERE WERE NO RESTRICTIONS ON THAT CONSERVATION EASEMENT. SO WHETHER IT'S RESTRICTED OR NOT RESTRICTED, IT'D BE NICE TO CLARIFY THAT. AND SO ANYWAY, I'M BASICALLY ASKING FOR A TOUR ABOUT NOT ON A DAY LIKE TODAY, BUT AND THEN TO REALLY UNDERSTAND WHAT THE HIKING POSSIBILITIES ARE. AND THEN WE HIKE ALL THE TIME AND WE GO TO FINLEY ROAD AND WELSH CREEK AND CEDAR CREEK, YOU KNOW, THE CEDAR CAMP TRAIL IN YOUR PARKS. THERE ARE NO SIDEWALKS. AND DURING THE WINTER MONTHS AND EVEN INTO THE SPRING, THERE'S THERE'S NATURAL SPRINGS AND THERE'S MUDSLIDES THAT THAT MAKE THAT WILL MAKE VEHICLE ACCESS. IT'S VERY DIFFICULT. AND I THINK IT WOULD HAVE THE VERY, VERY BIG PROBLEM EVEN WITH, WITH THE WALKING AND THE BICYCLES THERE ON THE MAIN TRAIL, MAIN ROAD GOING IN THERE. THAT'S THAT'S REALLY KIND OF A CONCERN OF MINE. AND ALSO I'D LIKE TO POINT OUT THAT IN ADDITION TO THE DOOLAN CANYON PRESERVE. THERE IS ALSO THE DOOLAN CANYON BANK, WHICH IS PRIVATELY OWNED, AND IT'S 1100 ACRES OF HABITAT. AND THIS HABITAT WAS ESTABLISHED TO PERMANENTLY PROTECT RARE NATIVE SPECIES AND NATURAL OPEN SPACE HABITATS IN THE REGION OF NORTHERN ALAMEDA COUNTY. THE ROLLING GRASSLANDS, VERNAL POOLS, WETLANDS, AND OTHER SENSITIVE HABITATS ON SITE ARE CAREFULLY MONITORED TO MAINTAIN COMPREHENSIVE LAND MANAGEMENT STRATEGY THAT INCLUDES ECOLOGICAL MINDED CATTLE GRAZING IN ORDER TO ENSURE PERPETUAL PROTECTION. THE VIABILITY OF THESE HABITATS. NOW, DUE TO THE HIGHLY SENSITIVE NATURE OF THESE THESE HABITATS THERE IS NO PUBLIC ACCESS WHATSOEVER THERE. AND WITH THAT BEING SAID, ALL AROUND THERE, I WOULD I WOULD LIKE THE EAST BAY PARK DISTRICT TO CONSIDER FOLLOWING SIMILAR LAND MANAGEMENT STRATEGIES TO PROTECT THE SENSITIVE HABITAT ON THE RESERVE. AND I THINK IT WOULD BE WELL MINDED TO, TO FOLLOW IN SUIT WITH THE SURROUNDING PROPERTIES. SO THESE, THESE SENSITIVE HABITATS CAN BE MANAGED. THE REASON FOR THAT IS THAT THERE'S A DEARTH OF PARK ACTIVITIES AND TRAIL ACTIVITIES IN COMPARISON TO THE WEST SIDE OF ALAMEDA COUNTY AND ALL OF CONTRA COSTA COUNTY. WITH THAT BEING THE CASE AND BEING RECOGNIZED FOR THE PERIOD OF TIME THAT IT HAS BEEN QUITE SOME TIME AGO, AND WIESKAMP SUGGESTED THAT THERE BE A COLLABORATION TO PROVIDE ACCESS TO THE DOOLAN CANYON RESERVE. SHE CAME TO ME AND ASKED ADVICE REGARDING THAT WITH A GROUP OF STAKEHOLDERS. THE GOOD NEWS IS THAT COMING FROM THAT IS AN EXISTING CONTRACT WITH EAST BAY REGIONAL PARK DISTRICT THAT HAS BEEN EXECUTED. IT WAS APPROVED BY THE BOARD OF DIRECTORS OF EAST BAY REGIONAL PARK DISTRICT. IT WAS APPROVED BY THE GENERAL MANAGER AND IT HAS BEEN EXECUTED. THE MONEY FUNDING THAT ACCESS IS SITTING IN AN ESCROW ACCOUNT AND THE ESCROW ACCOUNT HOLDER, [00:50:01] OLD REPUBLIC I THINK IS THEIR NAME, IS GETTING SO PEEVED ABOUT HANGING ONTO THIS MONEY FOR SO LONG THAT THEY'RE THREATENING TO LITIGATE WITH EAST BAY REGIONAL PARK DISTRICT AND MY FAMILY TO RELEASE IT. SHOULD THAT HAPPEN, THE FUNDS THAT ARE AVAILABLE TO PAY FOR ACCESS TO DOOLAN AND PRESERVE ARE GOING TO BE MINIMIZED BY LITIGATION. AND AND UNFORTUNATELY I ANTICIPATE THAT'LL TURN INTO QUITE THE MESS WITH THAT BEING THE CASE I STRONGLY RECOMMEND THAT THAT OPTION OF JUST USING AN EXISTING ACCESS STAGING AREA AND TO EXISTING ROUTES, 1 BEING A MULTI-PURPOSE TRAIL AND THE OTHER BEING A FINISHED ROAD. USING THOSE TO ACCESS THE PARK SEEMS TO MAKE A LOT OF SENSE. I'VE HEARD AGREEMENT FROM EVERY COMMUNITY MEMBER REGARDING THAT. I THINK IT'S LOST TO EAST BAY REGIONAL PARK DISTRICT, HISTORICALLY, THAT THERE ARE OTHER DISTRICTS IN THE AREA AND OTHER JURISDICTIONS IN THE AREA THAT THE PARK DISTRICT SERVES. FAILING TO RECOGNIZE THE DESIRES OF THOSE OTHER JURISDICTIONS IS NOT SOMETHING THAT GAINS A LOT OF RESPECT FROM THE COMMUNITY AT LARGE. SO THERE IS THIS PUSH AND PULL THAT EXISTS IN ALAMEDA COUNTY BETWEEN CONSERVATION AND RECREATIONAL USES THAT CAN'T BE DENIED. BUT THE RECREATIONAL ASPECTS HAVE BEEN DENIED FOR TOO LONG IN THE COMMUNITY. IT'S TIME TO TAKE A LOOK AT THAT AND ADDRESS SOLUTIONS THAT HAVE ALREADY BEEN EXECUTED. THANK YOU. YOUR TIME IS UP. BECAUSE THERE ARE ALREADY VEHICLES THAT DO GO ON THAT ROAD, I THINK THAT IT SHOULD BE OPEN TO HIKERS.
