ESTUARY PARTNERSHIP TO ACCEPT FUNDS FOR THE HAYWARD AREA SHORELINE PLANNING AGENCY, HASPA.

KATY HORNBECK, GRANTS MANAGER, HERE TO DO A QUICK PRESENTATION REQUESTING YOUR RECOMMENDATION TO THE FULL BOARD FOR AUTHORIZATION TO ENTER INTO A FUNDING AGREEMENT WITH THE SAN FRANCISCO ESTUARY PARTNERSHIP.

SO IN 2023, THE SAN FRANCISCO ESTUARY PARTNERSHIP, OR SFEP, THEY SUBMITTED A GRANT APPLICATION TO THE ENVIRONMENTAL PROTECTION AGENCY.

THE EPA HAS A PROGRAM CALLED SAN FRANCISCO BAY WATER QUALITY IMPROVEMENT FUND.

SO SFEP REACHED OUT TO THE PARK DISTRICT AND ASKED IF WE WOULD BE INTERESTED IN BEING A PARTNER IN THEIR APPLICATION.

THEY WOULD BE THE LEAD APPLICANT, AND WITHIN THEIR APPLICATION, THERE WOULD BE A TASK CARVED OUT FOR THE PARK DISTRICT TO COMPLETE WITH FUNDS ASSOCIATED WITH THAT.

I'LL NOTE THAT THE PARK DISTRICT SUBMITTED AN APPLICATION TO THIS PROGRAM LAST YEAR AS WELL FOR THE BROOKS ROAD PROJECT AT TILDEN, WHICH WE WERE AWARDED THAT FUNDING, BUT SFEP SUBMITTED AN APPLICATION SPECIFICALLY CALLED THE PIVOT POINTS MOVING NATURE BASED SOLUTIONS FOR WATER QUALITY IMPROVEMENT AND SHORELINE ADAPTATION FROM PLANNING TO ACTION.

THIS PARTICULAR GRANT PROGRAM REQUIRES EITHER A PARTNER OR ONE OR MORE PARTNERS, OR THAT YOUR PROJECT IS LOCATED WITHIN A DISADVANTAGED COMMUNITY, AND SO FOR OUR PROJECT FOR THE BROOKS ROAD PROJECT, WE PARTNERED WITH THE SAN FRANCISCO ESTUARY INSTITUTE AND SFEP PARTNERED WITH US, AND I BELIEVE 1 OR 2 OTHER AGENCIES.

SO WITHIN THEIR WITHIN THEIR GRANT PROPOSAL, THE TASK ASSOCIATED TO THE PARK DISTRICT AND WHAT WE WOULD IMPLEMENT AND RECEIVE GRANT FUNDS FOR WOULD BE THE DEVELOPMENT OF AN IMPLEMENTATION STRATEGY FOR THE HAYWARD AREA SHORELINE PLANNING AGENCY, OR HASPA.

HASPA SHORELINE ADAPTATION MASTER PLAN, AND STRENGTHENING HASPA'S CAPACITY FOR GOVERNANCE OF NATURE BASED SOLUTIONS PROJECTS IN THEIR MASTER PLAN IN THE LONG TERM.

I'LL SAY THAT THERE'LL BE A PRESENTATION LATER THIS MORNING TALKING MORE IN DEPTH ABOUT HASPA.

SO HOPEFULLY ANY QUESTIONS YOU HAVE ON HASPA SPECIFICALLY CAN BE ANSWERED THEN AND THEN I CAN ADDRESS ANYTHING GRANT RELATED, BUT I'LL GIVE A VERY BRIEF BACKGROUND ON HASPA.

SO THE MASTER PLAN WAS ADOPTED BY THE HASPA BOARD OF TRUSTEES, WHICH WE ARE A PART OF IN 2021.

THIS MASTER PLAN DETAILS A SERIES OF NATURE BASED ADAPTATION STRATEGIES TO PROTECT THE HAYWARD SHORELINE, BUT RIGHT NOW, THERE'S NO PRIORITIZATION OF INDIVIDUAL PROJECTS, AND

THAT INCLUDES FEASIBILITY, COST EFFECTIVENESS, AND ENVIRONMENTAL BENEFIT.

BECAUSE THE PARK DISTRICT HAS BEEN THE ADMINISTRATIVE LEAD FOR HASPA, THAT'S WHY SFEP HAD REACHED OUT ASKING IF THEY INCLUDED THIS SCOPE OF WORK IN THEIR APPLICATION, WOULD WE BE WILLING TO ADMINISTER AND MANAGE THAT TASK WITHIN THE WITHIN THE GRANT APPLICATION IF WE RECEIVED FUNDS? SO WE AGREED TO DO THAT.

IF THEY WERE SELECTED FOR GRANT FUNDING, WITH THE EXPECTATION THAT WE WOULD THEN NEED TO GET APPROVAL FROM OUR BOARD TO ENTER INTO A FUNDING AGREEMENT TO RECEIVE THOSE FUNDS TO COMPLETE THE WORK.

THE SCOPE OF WORK IS TWOFOLD.

THERE'S TWO TASKS. ONE IS THE HASPA IMPLEMENTATION.

SO ADMINISTERING HASPA, SELECTING THE TEAM, COMMUNITY ENGAGEMENT, IDENTIFICATION AND DESIGN OF DEMONSTRATION PROJECTS, AND THEN OTHER TECHNICAL STUDIES TO IDENTIFY HOW TO PRIORITIZE PROJECT PLANS AND THEN HASPA JPA GOVERNANCE.

SO THE ASSESSMENT OF HASPA JPA GOVERNANCE EVALUATION, INCLUDING OUTREACH AND ENGAGEMENT, AND THEN STRATEGIES AROUND HOW THE FUNDING, HOW THE PERMITTING, HOW [INAUDIBLE] WAS GOING TO WORK FOR ALL OF THE PROJECTS WITHIN THAT MASTER PLAN.

SO THE FUNDING AGREEMENT, SFEP IS THE LEAD AGENCY.

THEY ARE THE ONES THAT WILL HAVE A GRANT AGREEMENT WITH THE EPA AND ARE HELD RESPONSIBLE FOR MEETING ALL GRANT OBLIGATIONS.

THE PARK DISTRICT WOULD BE A SUB-AWARDEE, SO OUR AGREEMENT WOULD BE WITH ONLY SFEP.

EXCUSE ME, SFEP FOR THE AMOUNT OF 550,000, WHICH COVERS THE ENTIRE COST OF THOSE TWO TASKS THAT I MENTIONED EARLIER.

STAFF TIME WILL BE TRACKED AS MATCH OR IN-KIND SERVICES FOR THE WORK DONE ON ON THE GRANT.

SO THE RECOMMENDATION IS ASKING THAT THE BOARD EXECUTIVE COMMITTEE RECOMMEND THIS ITEM TO THE FULL BOARD FOR AUTHORIZING ENTERING INTO A FUNDING AGREEMENT WITH SFEP TO ACCEPT THOSE FUNDS FOR THE HASPA SHORELINE MASTER PLAN IMPLEMENTATION PROJECT IN THE AMOUNT OF 550,000, AND WE'LL GO TO THE BOARD WITH THIS SOMETIME IN MAY, AND THAT IS IT.

HASPA'S BEEN AROUND, LIKE YOU SAID SINCE 1970, BUNCH OF WONDERFUL PEOPLE TRYING TO PRESERVE THE SHORELINE DOWN THERE AND WE KIND OF GOT REALLY SERIOUS ABOUT IT IN 2021 AND DECIDED TO GO WITH A MASTER PLAN.

WE GOT A GRANT FOR THAT, AND I'M SURE I DON'T WANT TO STEAL DEVAN'S THUNDER BECAUSE HE'S GOING TO BRING IT UP IN THE NEXT COUPLE SECTIONS, BUT WE WERE ABLE TO HAVE A MASTER PLAN.

NOW ALL WE NEED IS MONEY, AND YOU'RE DOING A GREAT JOB OF GETTING THOSE GRANTS BECAUSE THE WHOLE ADMINISTRATION IMPLEMENTATION OF THE MASTER PLAN IS GOING TO BE A REAL CHALLENGE FOR US. SO THANKS SO MUCH.

PLEASED TO BRING YOU A BRIEF REPORT ON THE STATUS OF THE HAYWARD AREA SHORELINE PLANNING AGENCY, HASPA, WHICH YOU'VE JUST LEARNED ABOUT THANKS TO KATY AND SPECIFICALLY THE NEW JOINT POWERS AUTHORITY AGREEMENT, WHICH IS BEING CONSIDERED FOR ADOPTION.

AS DIRECTOR WAESPI KNOWS WELL, THE HAYWARD SHORELINE IS A UNIQUE ENVIRONMENT ON THE EDGE OF SAN FRANCISCO BAY.

IT IS HOME TO ENDANGERED BIRDS, WHICH THE PARK DISTRICT IS ACTIVELY ENCOURAGING TO NEST AND TO FLOURISH, AND RECREATIONAL AMENITIES SHOWN HERE LIKE THE BAY TRAIL.

EXCUSE ME. THIS IS I'VE GONE TOO FAR, TOO FAST.

OKAY, HERE WE GO.

SO, HASPA, AS DIRECTOR WAESPI MENTIONED IS A 54 YEAR OLD JOINT POWERS AUTHORITY FORMED BY THE PARK DISTRICT, THE CITY OF HAYWARD AND THE HAYWARD AREA RECREATION AND PARK DISTRICT, OR HARD.

ORIGINALLY, HASPA WAS FORMED TO ADD LAND TO THE SHORELINE TO PROTECT IT FROM DEVELOPMENT AND TO COORDINATE PROJECTS BETWEEN THE VARIOUS AGENCIES.

NOW, WITH CLIMATE CHANGE AND IMPACTS FROM SEA LEVEL RISE ALREADY BEING FELT AND CAUSING TEMPORARY DAMAGE TO OUR FACILITIES THERE, WHICH IS THE HAYWARD REGIONAL SHORELINE.

HASPA NEEDS AN UPDATED LEGAL AGREEMENT AND NEEDS MORE MEMBERS TO START BUILDING THE ADAPTATION PROJECTS AT THE SHORELINE, WHICH WILL KEEP THIS HABITAT AND RECREATION AMENITIES AVAILABLE TO ALL FOR THE FUTURE, AND FOR THE LAST YEAR AND A HALF, WE'VE INCLUDED TWO POTENTIAL TRUSTEE AGENCIES IN MEETINGS AND DISCUSSIONS ABOUT EXPANDING HASPA TO BECOME A FIVE MEMBER AGENCY.

THAT'S THE ALAMEDA COUNTY MOSQUITO ABATEMENT DISTRICT AND THE ORO LOMA SANITARY DISTRICT.

SO HASPA'S BOUNDARY, AS SHOWN HERE IN BLACK, IS BASICALLY NORTH OF THE HAYWARD SAN MATEO BRIDGE, SOUTH OF THE UNINCORPORATED SAN LORENZO BOUNDARY, WEST OF THE UNION PACIFIC RAILROAD TRACKS, AND INCLUDES SEVERAL MILES OF SAN FRANCISCO BAY SHORELINE.

WHILE THIS LOOKS SIMPLE AND SORT OF UNIFORM AT THIS ELEVATION, I'LL SHOW YOU ANOTHER MAP IN A MOMENT THAT SHOWS JUST QUITE HOW COMPLEX THE LAND OWNERSHIP IS HERE.

SO IT'S A LITTLE HARD TO SEE ON THIS MAP, BUT IN DARK GREEN ARE THE EAST BAY REGIONAL PARK DISTRICT OWNED PROPERTIES WHICH MAKE UP THE HAYWARD REGIONAL SHORELINE.

WE ACTUALLY ARE THE LARGEST LANDOWNER AT ABOUT 40%.

THE NEXT LARGEST LANDOWNERS ARE HARD, AND THE CITY OF HAYWARD EACH AT ABOUT 20% AND THEN FURTHER DOWN SMALLER LAND OWNERSHIP, BUT EQUALLY CRUCIAL ARE ALAMEDA COUNTY FLOOD CONTROL AND THE ORLEANS SANITARY DISTRICT.

THEY HAVE REALLY CRUCIAL INFRASTRUCTURE LIKE SANITARY FACILITIES AND FLOOD CONTROL PROTECTION FACILITIES, ALL WHICH LINE THROUGH THIS AREA.

SO IDEALLY, HAPSA WOULD HAVE BOTH OF THESE AGENCIES IN ITS BOARD OF TRUSTEES AND STAFF IS WORKING TO MAKE THAT HAPPEN, AND JUST AS AN ASIDE, I DON'T KNOW IF I CAN USE A POINTER, BUT DECO WAS CURRENTLY WORKING ON THE DESIGN FOR THE HAYWARD MARSH RESTORATION PROJECT, WHICH IS SHOWN IN THE DARK GREEN PROPERTIES CLOSEST TO THE HAYWARD BRIDGE DOWN THERE AT THE SOUTH OF THE OF THE MAP.

IF YOU'VE HEARD ABOUT THE HAYWARD MARSH RESTORATION.

SO, AS KATY WAS MENTIONING, AS DENNIS WAS MENTIONING, THE HAYWARD REGIONAL SHORELINE ADAPTATION MASTER PLAN WAS DEVELOPED AND APPROVED IN 2021.

I'VE GOT A COPY HERE, IF ANYONE'S EVER CURIOUS.

THE MASTER PLAN IS VERY AMBITIOUS.

IT'S GOT ABOUT 20 DIFFERENT PROJECTS IN IT THAT ADD UP BACK THEN TO ABOUT $1 BILLION COST.

THAT COST, AS DIRECTOR WAESPI HAS SAID, HAS SURELY RISEN TODAY.

ONE OF THE GAPS IN THIS PLAN, WHICH THAT GRANT THAT KATY WAS MENTIONING WILL HELP US ADDRESS, IS THAT AS COMPREHENSIVE AS THIS PLAN WAS, THERE NEEDS TO BE A REFINED IMPLEMENTATION EFFORT TO DECIDE WHICH OF THESE 20 PROJECTS ARE ABLE TO MOVE FORWARD, WHICH ARE FUNDABLE, WHICH ARE FEASIBLE, WHICH ARE GOING TO BE THE MOST EFFECTIVE AND EVENTUALLY BUILT.

SO THE HAYWARD MARSH RESTORATION PROJECT IS ONE OF THOSE.

THAT'S ONE OF OUR PROJECTS, AND THERE'S ANOTHER ONE YOU MAY HAVE HEARD OF CALLED THE FIRST MILE LEVEE PROJECT, WHICH IS AN EFFORT BY A DIFFERENT JOINT POWERS AUTHORITY.

THAT'S TO BUILD A LIVING LEVEE AT THE HAYWARD.

EXCUSE ME, THE ORO LOMA MARSH, AND WE CAN TALK ABOUT THAT MORE A LITTLE BIT LATER.

SO WHAT ARE THE EFFECTS OF SEA LEVEL RISE ON THE HAYWARD SHORELINE? THIS MAP SHOWS ONE SCENARIO, A VERY MODEST SCENARIO COMPARED TO ALL THE OTHERS THAT ARE OUT THERE OF TWO FEET OF SEA LEVEL RISE.

YOU CAN SEE THAT IN THIS SITUATION, ABOUT HALF OF THE SHORELINE WOULD BE INUNDATED, AND THEN IF YOU TAKE THAT SAME SCENARIO AND ADD 100 YEAR STORM SURGE

WITH SOME OF THE STORMS WE'VE HAD IN THE PAST, YOU SEE THAT IN FACT, MOST OF THE SHORELINE IS INUNDATED WITH ONLY THE COUNTY LANDFILL THERE IN THE MIDDLE, WHICH WOULD NOT BE, AND YOU CAN NOTICE THAT THE FOOTINGS OF THE HAYWARD SAN MATEO BRIDGE ARE ALSO INUNDATED.

SO THAT'S OUR CHALLENGE.

HOW DO WE PROTECT AGAINST THIS? WELL, ONE OF THE WAYS TO DO THAT IS TO STRENGTHEN HASPA, AND WE'VE BEEN NEGOTIATING SINCE 2022 WITH THE FIVE AGENCIES.

WHAT WE'LL HAVE BEFORE YOU IN A FEW MONTHS OR NEXT MONTH WILL BE A NEWLY NEGOTIATED JOINT POWERS AUTHORITY AGREEMENT, WHICH WILL EXPAND HASPA FROM THREE AGENCIES TO FIVE, AND THERE'S CURRENTLY A PLAN EVEN BEING DRAFTED TO ADD MORE AGENCIES.

HASPA HAS A POSITION RIGHT NOW THAT WE COULD BECOME A SUBREGIONAL AGENCY, WHAT'S CALLED A SUBREGIONAL AGENCY FOR CLIMATE ADAPTATION, WHICH FITS IN WITH THE NEW STATE LAW THAT THE SAN FRANCISCO BAY CONSERVATION DEVELOPMENT COMMISSION IS IMPLEMENTING.

THAT'S SB 272.

SO THIS NEW JPA WILL ALLOW FOR THE HAYWARD SHORELINE SPECIFIC PLANNING AGENCY HASPA, TO APPLY FOR GRANTS, AS YOU'VE HEARD ALREADY, PURSUE FUNDING AND COMPLETE SOME OF THE ADAPTATION PROJECTS IN THE MASTER PLAN.

SO IT WILL ALLOW THE PARK DISTRICT SPECIFICALLY, WHICH IS WHY WE'RE HERE TODAY, TO DIRECTLY PARTICIPATE IN THE FUTURE PROTECTION OF THIS CRUCIAL MARSH HABITAT FOR ENDANGERED SPECIES, WHICH INCLUDES SALT MARSH, HARVEST MOUSE, AND THE LEAST TERN, AND ALSO THE RECREATIONAL FACILITIES.

SO I'LL JUST QUICKLY SHOW YOU ONE COMPONENT OR TWO COMPONENTS OF THE JPA AND THEN WE'LL FINISH UP.

ONE OF THE IMPORTANT THINGS THAT WE DID WAS LOOK AT ALL THE DIFFERENT AGENCIES THAT WANT TO BE PART OF HASPA, AND WE NOTICED VERY QUICKLY THAT SOME ARE VERY SMALL IN TERMS OF THEIR OPERATING BUDGET, AND SOME ARE QUITE LARGE, INCLUDING THE PARK DISTRICT.

SO WE CREATED THREE TIERS OF MEMBERSHIP DUES SO THAT DIFFERENT AGENCIES COULD PARTICIPATE AT DIFFERENT LEVELS, AND THE SMALLEST, OF COURSE, AS YOU SEE HERE IS THE ALAMEDA COUNTY MOSQUITO ABATEMENT DISTRICT.

THE LARGEST WOULD BE US AS THE PARK DISTRICT, BUT I JUST WANT TO NOTE THAT OUR MANDATE INCLUDES, YOU KNOW, TWO FULL COUNTIES AND HAYWARD.

SHORELINE IS JUST A VERY SMALL PART OF OUR OVERALL PERCENTAGE.

SO THE PARTIES HAVE NEGOTIATED THIS TIERED DUES STRUCTURE TO BE FLEXIBLE AND FAIR FOR ALL OF THESE DIFFERENT LEVELS OF OPERATING BUDGET AND RESPONSIBILITY AND THEN THE LAST DETAIL I'LL SHOW YOU IS THE IDEA OF WEIGHTED VOTING, SO THAT THE PARTIES AGREED TO TIE THESE THREE TIERS OF MEMBERSHIP TO BOTH THE ANNUAL DUES OF THE ORGANIZATION AND TO THE IDEA OF WEIGHTED VOTING, WHICH I WON'T GET INTO, OTHER THAN TO SAY THAT THE PARK DISTRICT SHOWN HERE WOULD HAVE ABOUT 24% OF THE TOTAL DUES, WHICH WE'RE PROJECTING TO BE ABOUT 130,000 IN THE FIRST YEAR.

IF WEIGHTED VOTING WERE EVER CALLED FOR, WE WOULD ALSO HAVE 24% OF A VOTE.

I'M SEAN DOUGAN, I'M THE TRAILS PROGRAM MANAGER IN THE ACQUISITION, STEWARDSHIP AND DEVELOPMENT DIVISION AND TODAY I'LL BE GIVING YOU AN UPDATE ON THE SAN FRANCISCO BAY TRAIL RICHMOND GAP CLOSURE, ALSO KNOWN AS THE PINOLE, SORRY, POINT PINOLE TO WILSON POINT PROJECT, AND I'LL GIVE YOU AN OVERVIEW OF SOME OF THE HISTORY WHERE WE ARE WITH THE PROJECT, BUT ALSO, THIS IS ONE OF TWO STOPS INTERNALLY THAT WE TAKE ON A FOR THE CEQA PROCESS.

SO THIS IS CONSIDERED A PUBLIC MEETING UNDER THAT PROCESS AS WELL.

YOU'VE SEEN THIS SLIDE BEFORE.

WE'VE BEEN DOING A LOT OF WORK IN THE NORTHWEST PORTION OF CONTRA COSTA COUNTY, AND OTHER AGENCIES HAVE AS WELL.

YOU CAN SEE THE GAPS THAT STILL EXIST IN THE BAY TRAIL IN ORANGE AND COMPLETED GAPS.

I'M SORRY, AND COMPLETED PROJECTS IN GREEN.

THE CIRCLE SHOWS THE POINT PINOLE TO WILSON POINT SEGMENT.

IT'S ABOUT 0.9 MILES AND WHEN COMPLETED ALONG WITH THESE OTHERS IN ORANGE, THERE WILL BE ROUGHLY A 30 MILE CONTINUOUS SEGMENT OR SECTION OF THE BAY TRAIL FROM CROCKETT TO OAKLAND.

SO MOVING WEST TO EAST OR LEFT TO RIGHT ON THE PROJECT, WE START AT THE POINT BUSINESS PARK NEAR POINT PINOLE. THE AREA IN RED THERE IS KIND OF WHAT YOU'RE LOOKING AT IN THE PHOTO.

OVER THE LAST SEVERAL YEARS, THESE WAREHOUSES HAVE BEEN BUILT WITHIN THE BUSINESS PARK, AND THEY'VE ALSO BUILT A SEGMENT OF THE BAY TRAIL ALONG WITH THEIR IN THE PROPERTY THAT THEY'RE DEVELOPING.

SO IT'S ABOUT A MILE FROM ATLAS ROAD TO THE TERMINUS YOU SEE THERE RIGHT HERE AT THE END OF THIS FENCE, AND THEN YOU CAN SEE THAT THERE'S A WETLAND HERE.

THE RAILROAD IS JUST ABOVE IT, AND THERE'S A SLOPE DOWN TO IT WHICH IS A CHALLENGING SITE TO BUILD A TRAIL THROUGH.

WE DID A STUDY, COMPLETED A STUDY IN 2005, AND WE LOOKED AT SEVERAL WAYS TO GET THROUGH THIS AREA.

ACTUALLY, TWO WAYS IN PARTICULAR WERE EITHER FILLING NEXT TO THE RAILROAD AND IN THE WETLAND ON A LEVEE LIKE STRUCTURE FOR THE TRAIL OR BUILDING BOARDWALK STRUCTURES ON PIERS THROUGH THESE AREAS, YOU CAN SEE THE TWO DOTS.

THERE ARE WETLAND FEATURES THAT WILL NEED TO BE TRAVERSED.

THERE'S ACTUALLY ONE FRESHWATER WETLAND COLLECTING WATER FROM UPLAND FLOW, AND THEN THERE'S A TIDALLY INFLUENCED WETLAND AS WELL.

THERE'S STILL ADDITIONAL RIGHT OF WAY THAT WE NEED FOR THIS PROJECT, BUT WE'RE PIECING THAT TOGETHER AS WE GO THROUGH.

WE'VE TALKED TO THE THERE'S A 50 FOOT WIDE EASEMENT.

ALONG THIS SECTION HERE THAT WE ARE FINALIZING FROM THE DEVELOPER OF THE OF THE POINT PINOLE BUSINESS PARK.

THE COUNTY ACTUALLY OWNS THIS BALL FIELD AND COMMUNITY CENTER, AND WE'VE TALKED TO THEM AND ARE IN ACTIVE NEGOTIATIONS OVER AN EASEMENT THAT WE CAN ACQUIRE FROM THEM HERE. THEY'RE NOT TERRIBLY CONCERNED, BUT THEY THIS PARK IS SOMETHING THAT THEY ARE LESS THAN ENTHUSIASTIC TO MANAGE.

IT DOESN'T RECEIVE A LOT OF USE.

IT'S SORT OF ISOLATED, AND OF COURSE, THOSE CONVERSATIONS ARE BEING DIRECTED OUR WAY AS WELL.

AS FAR AS THE FUTURE USE OF THIS PARK, BUT WE'RE DOING A TRAIL PROJECT.

WE ACTUALLY OWN A LITTLE STRIP OF PROPERTY HERE FOR ACCESS ALONG THIS PATHWAY, AND THEN THE SCHOOL DISTRICT, FORMER SEAVIEW SCHOOL PROPERTY THAT THE SCHOOL WAS DEMOLISHED SEVERAL YEARS AGO, AND THEY'RE DISCUSSING WHAT THE FUTURE USE OF THIS PROPERTY WILL BE.

THERE HAS BEEN A DEVELOPMENT PROPOSAL FOR DENSE HOUSING, AND THERE'S A COMMITTEE CALLED THE 711 COMMITTEE THAT HAS BEEN MEETING, AND AS A PART OF THAT COMMITTEE, THEY WILL RECOMMEND TO THE DISTRICT WHAT THE FUTURE USE OF THIS PROPERTY IS, BUT ONE OF THE RESOLUTIONS THAT THEY DID PASS IS THAT THEY WOULD GIVE THE PARK DISTRICT AN EASEMENT OVER A PORTION OF THIS LAND FOR THE SAN FRANCISCO BAY TRAIL.

WE ARE STILL WAITING TO HEAR THE FINAL CONCLUSION OF THAT, AND WE'RE FOLLOWING THAT VERY CLOSELY.

THERE'S THE CREEK THERE, TOO.

I SHOULD MENTION THAT'S GARRITY CREEK.

THERE'S A WHAT WE THINK IS ABOUT A 70 FOOT BRIDGE THAT IS PROPOSED TO GAP THAT, AND THEN WE ENTER INTO THE UNION PACIFIC RAILROAD PROPERTY, WHICH IS THIS IS A PART THIS PROJECT WAS PART OF THE AMENDED AND RESTATED 2016 MEMORANDUM OF UNDERSTANDING WITH UNION PACIFIC RAILROAD FOR A LONGITUDINAL EASEMENT ON THE OUTER 15FT OF THEIR TRACKS, AND THIS IS A GOOD VIEW HERE.

I DON'T KNOW IF YOU CAN SEE IT VERY WELL, BUT THERE'S AN OLD PIPE, THE CULVERT HERE, AND THERE'S SOME UTILITY ISSUES ON THIS HILLSIDE THAT ADD TO THE COMPLEXITY OF THIS PROJECT.

WE'LL NEED TO NOTCH A TRAIL IN THAT HILLSIDE, AND I'LL SHOW YOU AN EXHIBIT LATER.

THAT KIND OF GIVES YOU THE IDEA OF WHAT IT WILL LOOK LIKE, BUT THERE'S, WE WERE VERY CONCERNED AFTER THE 2005 STUDY THAT THERE WILL BE UTILITY RELOCATION ISSUES.

THERE'S A HIGH PRESSURE GAS LINE ALONG THE UNION PACIFIC RAILROAD TRACKS.

IT'S ALSO A FIBER OPTIC LINE, AND THERE WAS THIS ROGUE GAS LINE THAT WAS OWNED BY SHELL AND THEN TRANSFERRED, AND SO WE'VE BEEN INVESTIGATING THE HISTORY OF THESE UTILITIES, TRYING TO DETERMINE WHETHER OR NOT THIS PROJECT HAS A FATAL FLAW IN IT.

THE GOOD NEWS IS THAT WE DISCOVERED THAT GAS LINE THAT WAS UNKNOWN IS ABANDONED, AND WE CAN JUST SEVER IT AND CLOSE IT, AND THAT WILL SAVE HUNDREDS OF THOUSANDS, IF NOT $1 MILLION ON THE PROJECT COST POTHOLING TO FIND THE EXACT LOCATION OF THE OTHER UTILITIES ALONG UNION PACIFIC RAILROAD HAS BEEN DELAYED BY THE WEATHER AND THE RAIN, SO WE'RE HOPING TO HAVE THAT INFORMATION SOON.

THIS IS AN EXAMPLE OF THE THIS IS THE LOCATION OF THE EASEMENT ALONG THE UNION PACIFIC RAILROAD TRACKS.

JUST LOOKING THE OTHER WAY.

YOU CAN SEE THE GAS LINE MARKERS THERE.

SO WE WANT TO BE SURE WHERE EXACTLY THAT IS AND MAKE SURE THAT THERE'S NO CONFLICT.

SO AN INITIAL STUDY WAS COMPLETED AND IT WAS DETERMINED THAT A MITIGATED NEGATIVE DECLARATION WAS THE APPROPRIATE LEVEL OF CEQA ON THIS PROJECT.

THERE WILL BE A MITIGATION MONITORING AND REPORTING PROGRAM INCLUDED WITH THIS ONCE IT'S RELEASED, AND MOST OF THE MITIGATION MEASURES IN THIS DOCUMENT REALLY PERTAIN TO BIOLOGICAL RESOURCES, HABITAT RESOURCES AND THE WETLANDS THAT I MENTIONED EARLIER.

WE'LL NEED TO MITIGATE FOR THAT ONCE WE DETERMINE WHAT THOSE IMPACTS ARE.

THE PARK DISTRICT SENT OUT LETTERS ON MARCH 12TH TO TRIBES ON THE NATIVE AMERICAN HERITAGE COMMISSION LIST TO DETERMINE IF ANY OF THE TRIBES WANTED TO FORMALLY CONSULT ON THIS PROJECT. WE'VE HEARD FROM SEVERAL, BUT THAT PROCESS IS NOT ENDING UNTIL MARCH.

APRIL 11TH. PARDON ME.

WHERE THAT WINDOW TO RESPOND CLOSES.

ONCE WE FINISH THAT PROCESS, WE WILL INCORPORATE ANY MITIGATION MEASURES THAT WE COME UP WITH IN CONSULTATION WITH THE TRIBES, AND WE WILL HOPEFULLY HAVE A DRAFT DOCUMENT BY THIS SUMMER TO BE RELEASED FOR A 30 DAY PERIOD.

MOST OF THE VEGETATION IN THE AREA IS NON-NATIVE GRASSLANDS, BUT THERE ARE SOME WILLOW THICKETS AND CREEPING RYEGRASS IN THERE THAT WE'LL NEED TO MITIGATE FOR THERE. THOSE ARE CONSIDERED SENSITIVE NATURAL COMMUNITIES.

THERE ARE 15 LISTED WILDLIFE SPECIES THAT COULD POTENTIALLY RESIDE, FORAGE OR MOVE THROUGH THE SITE, AND THOSE INCLUDE THE CALIFORNIA RED LEGGED FROG, BURROWING OWL, AND THE WESTERN POND TURTLE, WHICH IS VERY LIKELY TO MOVE FROM A THREATENED SPECIES TO AN ENDANGERED SPECIES VERY SOON HERE BUT IN ORDER TO MITIGATE FOR THAT, WE ARE LEANING TOWARDS IN THE CURRENT DESIGN IS SUGGESTING THAT WE WILL BUILD BOARDWALK STRUCTURES OVER THESE WETLANDS, AND THAT WILL GREATLY REDUCE THE IMPACT TO THOSE SPECIES AND TO THOSE WETLANDS.

THERE ARE 2.2 ACRES OF WETLANDS IN TOTAL, BUT THE WAY THAT WE'RE DESIGNING IT, WITH A 710 FOOT BOARDWALK AND A 70 FOOT BRIDGE OVER GARRITY CREEK, THE PROJECT WILL ONLY PERMANENTLY IMPACT 0.366 ACRES OF THAT.

WE HAD A COMMUNITY MEETING IN SEPTEMBER OF 2023 AND MET AND NOTICED MULTIPLE TIMES THE NEIGHBORS AND TENANTS OF THESE HOMES AND THE OWNERS OF THOSE HOMES, AND HELD A COMMUNITY MEETING AT MONTALVAN OR MONTARABAY COMMUNITY CENTER, WHICH IS IN THAT BASEBALL PARK AREA, AND THEY THEY WERE CONCERNED MAINLY ABOUT VIEWSHED AND PRIVACY AND SECURITY ISSUES, AND SO AS YOU SEE THE DESIGN HERE, WE WERE ABLE TO SHOW THEM THAT ACTUALLY, WE'RE STABILIZING YOUR PROPERTY AND PUTTING IN A WALL THAT'S A SUNKEN ABOUT 6 TO 8FT BELOW YOUR PROPERTY SO YOU WON'T SEE PEOPLE.

SO THE SECOND SURVEY THAT WE RELEASED AND WE PUT ONLINE WAS QR CODE SURVEYS.

WE NOTICED THE NEIGHBORHOOD PUT UP NOTICES AT THE COMMUNITY CENTERS AND THE HOA ETC.

WE RECEIVED LIKE 477 RESPONSES FROM THAT, AND THE AND THE OVER 400 OF THEM WERE GET IT DONE QUICKER, MAKE IT HAPPEN, AND YOU CAN SEE SOME OF THE RESPONSES HERE.

THOSE ARE STATE TRANSPORTATION MITIGATION PROGRAM FUNDING FUNDS THAT THEY'RE COLLECTING THROUGH PROJECTS AND MITIGATION, AND THAT MAY BE ENOUGH TO GET US THROUGH FINAL DESIGN.

WE WILL LIKELY NEED MORE MONEY, BUT ONCE WE GET TO THAT POINT WHERE WE ADVERTISE FOR THAT, THAT PHASE WILL DETERMINE WHETHER THAT'S ENOUGH MONEY.

WE HAVE APPLIED OR WE YES, WE HAVE APPLIED FOR THE RAISE GRANT.

AS WE MENTIONED EARLIER, 6.4 MILLION IN THE REBUILDING AMERICAN INFRASTRUCTURE WITH SUSTAINABILITY AND EQUITY.

THOSE AWARDS ARE PENDING JULY 2024.

THAT WOULD BE FOR DESIGN AND CONSTRUCTION TO SUPPLEMENT THAT 500 IF WE NEED IT, AND THEN WE ARE PLANNING TO APPLY FOR ACTIVE TRANSPORTATION PROGRAM FUNDING THROUGH THE STATE AND THE NEIGHBORHOOD OF 3 TO 5 MILLION.

WE'VE ESTIMATED THIS PROJECT COULD BE 8 TO 12 MILLION, BUT WITH THE UTILITY GOOD NEWS AND SOME OF THE DESIGN ENGINEERING.

I FORGET WHAT THEY CALL IT VALUE ENGINEERING.

IT'S FOUR LEVELS.

IT'S A STEEL FRAME BUILDING OF APPROXIMATELY 107,000FT², OF WHICH APPROXIMATELY 65,000FT² IS OCCUPIABLE AND WILL BE UTILIZED FOR STAFF SPACE AND OFFICES.

SO AFTER THE PURCHASE IN 2019, DESIGN AND CONSTRUCTION BEGAN EFFORTS IN 2020 TO DEVELOP PLANS FOR THE TENANT IMPROVEMENTS AND RENOVATION OF THE BUILDING.

SO TO THAT, WE'VE COMPLETED MOST ALL OF THESE STEPS THAT ARE IN FRONT OF YOU.

THE BUILDING PROGRAM IS ABOUT DEFINING THE SPACE.

WHO ALL IS GOING TO BE IN THERE? WE ALSO DETERMINED THAT WE WERE SEEKING LEED CERTIFICATION OF GOLD SO THAT WE COULD SHOW THERE WAS MANY DISCUSSIONS ABOUT THAT, AND THAT WAS DETERMINED, WITH THE ASSISTANCE OF THE BOARD AS TO WHAT CERTIFICATION WE WOULD SEEK.

SO WE'RE HOPING THAT WE'LL HAVE OUR PERMITS IN HAND SOON FROM THE CITY OF OAKLAND.

THAT INCLUDES SITE PLANS, RENOVATION TENANT IMPROVEMENT PLANS, A DEMOLITION PLAN.

THESE ARE ALL THE PERMITS WE'RE APPLYING FOR FROM THE CITY OF OAKLAND.

IN ADDITION TO THAT, WE DID A PREQUALIFICATION PROCESS FOR CONTRACTORS.

WE PUT OUT A PROPOSAL FOR CONTRACTORS AT THE END OR IN NOVEMBER OF LAST YEAR.

WE HAD A PROCESS BY WHICH WE EVALUATED THEM FOR SIMILAR PROJECTS OF SIZE AND NATURE DONE IN THE LAST FEW YEARS.

WE BROUGHT THAT LIST TO THE BOARD IN JANUARY.

TOBY GAVE A PRESENTATION, AND THE BOARD APPROVED OUR SHORT LIST OF FOUR CONTRACTORS WHO WILL BE ABLE TO BID ON THIS PROJECT AND AT THE SAME TIME SELECTED A FURNITURE DEALER.

THAT SAID, THAT'S ALL CONTINGENT UPON FUNDING, I BELIEVE THE FINANCE COMMITTEE LAST WEEK THERE WAS A DISCUSSION OF THAT.

SO THIS IS CONTINGENT UPON GETTING ALL THE FUNDING THAT WE NEED, AND THEN WE'RE ANTICIPATING 18 MONTHS TO TWO YEARS TO COMPLETE THE PROJECT.

IN TERMS OF THE STRUCTURAL IMPROVEMENTS, THIS IS AN ESSENTIAL SERVICES BUILDING, AND IT IS WE ARE IN CLOSE PROXIMITY TO A FAULT, AND SO THERE WILL BE A LOT OF SEISMIC THAT HAS TO BE DONE TO THIS BUILDING TO MAKE IT FUNCTION AS WELL ONE FOR CODE IN PROXIMITY TO THE DEFAULT, BUT ALSO TO OPERATE AS AN ESSENTIAL SERVICES BUILDING, AND LIKE I SAID, IN TIMES OF EMERGENCIES HERE'S OUR ESTIMATED PROJECT COST AT THIS POINT BASED ON OUR CONSTRUCTION DOCUMENTS.

SO CONSTRUCTION IS ESTIMATED AT $70 MILLION.

WE HAVE $3 MILLION WITH CONSTRUCTION MANAGEMENT, WHICH INCLUDES CONTINGENCY COSTS.

I DID A QUICK SEARCH OF COMPARABLE FACILITIES IN TERMS OF WHAT HAS BEEN HAPPENING LOCALLY OR IN STATEWIDE FOR SIMILAR FACILITIES.

EL DORADO COUNTY DID A PUBLIC SAFETY COMPLEX, WHICH WAS COMPLETED IN 2019.

SO THAT WAS PRIOR TO PANDEMIC, AND IF YOU COULD RECALL, OR AS YOU ARE AWARE, SINCE THE PANDEMIC, COSTS HAVE ESCALATED A LOT, BUT IN THIS ONE THAT WAS COMPLETED IN 2019 COST 50 MILLION AND IT WAS 110,000FT².

MOUNTAIN VIEW, I BELIEVE THEIR CITY COUNCIL JUST APPROVED A $200 MILLION PROJECT.

IT'S NOT MOVING FORWARD, BUT THEY DID JUST RECENTLY APPROVE THAT.

I'M NOT SURE ABOUT THE SQUARE FOOTAGE OF THAT FACILITY.

SAN RAFAEL DID A 44,000 SQUARE FOOT BUILDING, AND IT'S HARD FOR ME TO DETERMINE.

I THINK THE BUILDING ITSELF WAS 36, BUT THEY HAVE A TOTAL COST OF 73 MILLION FOR AN ESSENTIAL FACILITY FACILITY.

SO THAT INCLUDES ALL OF THAT.

MARTINEZ CONTRA COSTA COUNTY JUST COMPLETED EMERGENCY OPERATE.

WELL, NOT JUST THEY COMPLETED IN 2020.

SO IT'S A SIMILAR ASPECT TO THE EL DORADO COROLLARY, WHERE THAT PRICING AND BIDDING WAS PROBABLY DONE PRE-PANDEMIC.

I'D LIKE TO RAISE AN ISSUE THAT WAS COVERED DURING THE BOARD'S TRAILS STUDY SESSION ON MARCH 1ST, AND WHICH TRACK COVERED IN A MARCH 4TH FOLLOW UP LETTER TO AGM WAUSAUKEE

AND THAT IS THE NEED TO START NEGOTIATING WITH THE RAILROADS TO OBTAIN AN EASEMENT TO EXTEND THE BAY TRAIL NORTH FROM POINT [INAUDIBLE] TO POINT SAN PABLO.

SO THERE'S NO NEED TO START DESIGNING THE TRAIL THIS TRAIL SECTION, BUT WHEN THAT TIME COMES, THE DISTRICT WILL NEED LAND TENURE OVER THAT STRETCH OF TRAIL.

IF YOU DON'T HAVE ACCESS TO THE LAND, YOU HAVE NOTHING.

15 YEARS AGO, CHEVRON AGREED TO PROVIDE AN EASEMENT OVER THEIR STRETCH OF LAND EXTENDING NORTH FROM POINT [INAUDIBLE].

HOWEVER, THERE'RE UNDERLYING PROBLEMS AND COMPLICATIONS IN TERMS OF A HISTORIC RAILROAD EASEMENT.

IT'S REALLY IMPORTANT FOR THE DISTRICT TO START NEGOTIATING THE RAILROADS.

THEY HAVEN'T DONE THIS. IT'S BEEN PUT OFF FOR 15 YEARS.

PUT OFF BECAUSE IT'LL BE DIFFICULT AND TAKE TIME.

WELL, THAT IS A REASON TO START THE NEGOTIATION.

IT TOOK THE DISTRICT 25 YEARS TO NEGOTIATE THE RAILROAD TO GET ACCESS TO THE SHORELINE OF THE WESTERN SHORELINE OF MILLER KNOX.

SO TRACK HOPES THE DISTRICT WILL OPEN DISCUSSIONS WITH THE RAILROAD TO EXTINGUISH THESE OLD HISTORIC RAILROAD EASEMENT SO IT WILL HAVE CLEAR TENURE OVER THAT STRETCH OF LAND.

CHEVRON IS WILLING TO COOPERATE.

SO THEY'RE NOT THE ISSUE.

THE ISSUE IS THE RAILROADS.

SO I'M HOPING THE STAFF WILL TAKE THIS ON.

I REALIZE IT'S CHALLENGING.

IT'LL TAKE TIME, AND BECAUSE IT WILL TAKE TIME, THAT'S THE REASON TO START NOW.
