AND I'M HERE TODAY TO TALK ABOUT A LEASE AGREEMENT AT AN EXISTING TELECOMMUNICATIONS SITE IN MISSION PEAK REGIONAL PRESERVE.

SO I'M JUST GOING TO GIVE YOU A QUICK RUN THROUGH OF THE RECOMMENDATION.

SO WE ARE HERE TO APPROVE OR GET YOUR APPROVAL OF A TELECOMMUNICATIONS SITE AGREEMENT WITH PINNACLE TOWERS, LLC, CROWN CASTLE INTERNATIONAL, FOR THE OPERATION OF A COMMUNICATIONS FACILITY LOCATED IN MISSION PEAK REGIONAL PRESERVE FOR ONE 10 YEAR PERIOD, WITH THE OPTION FOR AN EXTENSION FOR ONE 10 YEAR PERIOD, WITH A MONTHLY REVENUE OF $15,121.16, AND AN ANNUAL INCREASE BASED ON CONSUMER PRICE INDEX AND ADDITIONAL INCOME FROM ANY SUBLICENSES AT THE SITE.

SO A LITTLE BIT OF AN OVERVIEW.

THIS SITE THAT IS ON THE PICTURE HERE IS THE ACTUAL LOCATION.

AND ONE OF THE NEAT THINGS ABOUT THIS SITE IS IT WAS ONE OF THE FIRST SITES THAT THE DISTRICT MANDATED THAT THEY REBUILD TO BE LOW PROFILE.

SO THAT'S WHY THERE'S THIS SORT OF CUT IN THE HILLSIDE THERE AND THE BUILDING, WHICH YOU CAN KIND OF BARELY SEE.

THE ANTENNA OBVIOUSLY IS THERE, BUT THE BUILDING IS PRETTY LOW PROFILE TO THE GROUND.

SO WE'RE GOING TO THE OVERVIEW.

WE'RE GOING TO GO LOOK AT THE LOCATION, WHAT KIND OF ACCESS THEY HAVE TO THEIR SITE.

JUST A LITTLE BIT ABOUT THE EAST BAY REGIONAL PARK DISTRICT COMMUNICATION SITE POLICY AND THE SITES THEMSELVES.

A LITTLE BIT OF BACKGROUND ON THIS PARTICULAR SITE, THE TERM THAT WE WANT TO OFFER THEM FOR THEIR NEXT AGREEMENT AND THE RECOMMENDATION. SO HERE'S MISSION PEAK REGIONAL PRESERVE, WHERE THE RED CIRCLE IS, IS WHERE THE ACTUAL LOCATION OF THE SITE IS. SO IT'S IN THE SOUTHERN PART OF MISSION PEAK, CLOSER TO AT LEVIN PARK.

AND THE SITES THAT ARE THE PICTURES THAT ARE ON THESE TWO SITES.

ONE IS THE PG&E BLACK DIAMOND SITE, AND THEN THE OTHER ONE IS A REGULAR CELL SITE AT VASCO HILLS. AND THE REASON THAT I PUT THESE PICTURES ON THERE IS BECAUSE A LOT OF TIMES WHEN WE'RE TALKING ABOUT COMMUNICATION SITES IN OUR HEAD, WE ALL HAVE A DIFFERENT VISION OF WHAT THAT MEANS.

AND SO SOME PEOPLE THINK TELECOM SITE BIG, HUGE, GIGANTIC TOWERS WITH A GREAT BIG BUILDING.

AND YOU KNOW, THEY'RE NOT ALL THAT WAY.

SOME OF THEM LIKE THIS CELL SITE, IS JUST A COUPLE OF EQUIPMENT BOXES AND SOME DIFFERENT, YOU KNOW THEY'RE STILL CALLED A TOWER, BUT IT'S MORE LIKE A POLE WITH SOME SOMETIMES IT HAS ONE ROUND SATELLITE DISH, SOMETIMES IT HAS THESE LONG, SKINNY THINGS AND THAT KIND OF THING.

SO FOR THE PARK DISTRICT, WE HAVE 24 DIFFERENT LEASE AGREEMENTS.

AT 14 DIFFERENT SITES.

SO SOME SITES HAVE MULTIPLE AGREEMENTS.

SO ONE SITE AND ONE SITE ONLY IS BELONGS TO THE PARK DISTRICT.

THE REST OF THEM WE OWN THE LAND AND SOMEBODY ELSE OWNS THE SITE AND THE EQUIPMENT THERE.

SO THERE'S TWO SITES THAT ARE PUBLIC ENTITY.

ONE IS THE BRAND NEW CONTRA COSTA SITE WHERE THEY HAVE THEIR COMMUNICATIONS, THEIR OWN COMMUNICATIONS THERE, AND THEY SHARE IT WITH ONE OF OUR LEASES, WHICH IS KQED.

THAT'S AT CARQUINEZ STRAIT.

AND THEN THE OTHER ONE IS THE BAY AREA AIR QUALITY MANAGEMENT DISTRICT, AND THAT'S AT LAKE CHABOT.

AND IT'S JUST THIS IT WAS IT'S JUST A SKINNY, SKINNY LITTLE POLE WITH SOME LITTLE, LITTLE THINGS ON IT.

SO AS FAR AS THE COMMUNICATION SITE POLICY GOES, IT WAS APPROVED BY THE BOARD IN 1994.

IT HASN'T BEEN UPDATED IN ANY WAY TO INVOLVE NEW TYPES OF COMMUNICATIONS, INCLUDING CELL.

USUALLY WE DON'T USE THAT SITE OR THAT POLICY TOO MUCH BECAUSE WE HAVEN'T HAD VERY MANY NEW SITES THE LAST 20 YEARS.

THERE'S ONLY BEEN TWO NEW SITES, ONE OF WHICH WAS AN ADDITION TO AN EXISTING SITE, AND THAT ACTUALLY HAS GONE AWAY SINCE THEN.

AND THEN THE OTHER ONE WAS THE CONTRA COSTA COUNTY SITE.

MOST OF THE SITES THAT WE HAVE COME THROUGH LAND ACQUISITION.

SO THEY'RE AS IS WE BOUGHT THE PROPERTY AND THEY ALREADY HAD A CELL SITE THERE.

AND WE HONOR THOSE WHEN WE PURCHASE THE LAND.

WE NEVER SAY, OH, NOW IT'S OURS.

GET OUT OR WHATEVER.

WE, YOU KNOW, HONOR WHATEVER EXISTING LEASE THEY HAVE, EVEN IF IT'S A 50 YEAR LEASE.

AND THEN WHEN THEY COME UP FOR RENEWAL OR THEIR LICENSE EXPIRES WE IN GENERAL HAVE LET THEM, YOU KNOW, PROPOSE STAYING OR MAYBE THEY WANT TO GO AWAY BECAUSE THEY DON'T WANT TO PAY THE FEE ANYMORE, AND MAYBE THEY DON'T NEED THAT SITE ANYMORE.

THAT IS ACTUALLY HAPPENING AT TWO SITES.

IT HAPPENED ONCE LAST YEAR, AND IT'S HAPPENING AT TWO SITES THIS YEAR WHERE THEY'RE GOING AWAY.

SO AS I SAID EARLIER, THERE'S KIND OF DIFFERENT SIDES AND SOME OTHER AGENCIES HAVE DIVIDED THEM INTO WE DON'T CURRENTLY DO THIS, BUT IF I WAS PUSHED TO SORT OF TELL THE DIFFERENCE BETWEEN DIFFERENT SITES, IT'S A GOOD WAY OF KIND OF DESCRIBING THEM AS MACROCELL, MINICELL AND MICROCELL.

AND THAT JUST SORT OF GIVES YOU A VISUAL OF MACRO OF COURSE IS A BIGGER SITE, A MINICELL IS A TINY SITE, AND THEN A MICRO SITE IS TEENY TEENY TINY. AND WE DON'T HAVE ANY MICRO SITES.

USUALLY THERE ARE LESS THAN 300FT², AND EVEN IF ON THE AGREEMENT IT SAYS 200FT, WE STILL WOULDN'T CONSIDER IT MICRO BECAUSE IT IS STILL STANDING UP LIKE EIGHT FEET TALL AND THINGS LIKE THAT, OR MAYBE 12FT TALL FOR THE ANTENNA.

MOST MICRO SITES ARE JUST EQUIPMENT ON A TELEPHONE POLE.

AND THERE IS A PUBLIC BENEFIT INCLUDED IN THESE TELECOM SITES BECAUSE OBVIOUSLY, I THINK OVER EVERYBODY PRETTY MUCH HAS A SMARTPHONE

NOWADAYS. AND BECAUSE OF THAT WE NEED THESE SITES.

THEY PROVIDE, YOU KNOW, CONNECTIVITY.

AND THEN OBVIOUSLY THERE'S A PRETTY GOOD REVENUE STREAM THAT DOESN'T REQUIRE TOO MUCH OF PARK DISTRICT STAFF TIME TIED TO IT.

SO IN THAT RESPECT, IT'S A PRETTY GOOD REVENUE.

AND THIS IS THE BAY AREA QUALITY MANAGEMENT SITE.

THE SITE ON A WELL, I DON'T KNOW IF IT'S THE LEFT OR RIGHT, BUT THE TALL TOWER THERE WITH THE GUY STANDING AT THE BOTTOM, THAT'S THE BAY AREA QUALITY SITE . THIS IS A SATELLITE PICTURE OF THE SITE THAT WE'RE REVIEWING TODAY.

THEY HAVE BEEN THERE SINCE 1963.

NOT AT THIS PARTICULAR SITE.

THE NEW LOW PROFILE SITE WENT IN, IN 1995.

THEY HAVE A TOTAL OF ONE ACRE.

AND THEY ARE RESPONSIBLE FOR MAINTENANCE AT THE SITE.

THE PARK STAFF HAS NEVER COMPLAINED ABOUT THEM NOT TAKING CARE OF THE AREA WITHIN THEIR FENCE AND AROUND THEIR FENCE.

THEY CURRENT AGREEMENT, WHICH WAS AMENDED IN 1999, WILL END IN MAY OF THIS YEAR. AND PREVIOUS TO THIS, THEY WERE PAYING A FLAT FEE OR 13% OF THEIR GROSS RECEIPTS, WHICHEVER WAS GREATER.

SO AS FAR AS I KNOW, BECAUSE THEY HAD BEEN PAYING THE FLAT RATE, THEIR GROSS RECEIPTS WERE NEVER GREATER.

SO WITH THE RENEWAL, WE'RE GOING TO WE WANT TO GIVE THEM TEN YEARS WITH AN ADDITIONAL TEN YEARS, AND WE'LL START AT $15,121.16 PER MONTH, WITH AN ANNUAL CPI INCREASE, WITH ADDITIONAL MONEY OF 5% OF THEIR GROSS RECEIPTS COMING FROM THEIR SUBLICENSES.

AND JUST IN CASE, THIS IS KIND OF JUST AN INFORMATIONAL PART OF THIS, IS THAT IN GENERAL, WHEN WE LOOK AT THESE CON SITES, WE REFER TO MARKET RATES WHICH ARE PRETTY HARD TO GET.

NOT VERY MANY AGENCIES WANT TO, YOU KNOW, SEND ME A LIST OF ALL THE INCOME THAT THEY GET FROM THEIR TELECOM SITES.

GENERALLY, I COULD I MIGHT BE LUCKY TO GET A RESPONSE THAT SAYS, OH, WE GET ABOUT 3,000 A MONTH OR SOMETHING LIKE THAT.

BUT I HAVE GOTTEN WHAT INFORMATION I CAN, ALONG WITH HOW LONG THEIR TERMS ARE AND WHAT KIND OF INCREASE THEY HAVE ON THEIR REVENUE OVER THE YEARS.

AND SO THEN I JUST UPDATE THAT EVERY YEAR TO SEE IF WE'RE, YOU KNOW, COMPARABLE TO WHAT OTHER AGENCIES ARE GETTING.

AND ALSO WHEN I JUST SHOW A LIST OF MARKET RATES, IT'S KIND OF ALL OVER THE PLACE BECAUSE THESE SITES ARE DIFFERENT SIZES, THEY HAVE DIFFERENT AMOUNTS OF EQUIPMENT, THEY HAVE DIFFERENT AMOUNTS OF SUBLICENSES AND THINGS LIKE THAT.

SO THE CURRENT MARKET RATES THAT I LOOK AT IS 36 COMPARISONS WITH OUR SITES AND OTHER AGENCY SITES, AND THAT INCLUDES THE STATE OF CALIFORNIA.

AND THIS IS.

WHOOPS. IT SHOWS ON MINE, BUT NOT ON THIS.

OH, THERE IT GOES. OKAY, IT'S A LITTLE SLOW.

THIS IS JUST A GRAPH TO SHOW WHAT THIS PARTICULAR SITE MAKES IN REVENUE IN COMPARISON TO ALL THE OTHER MARKET RATES THAT I HAVE, INCLUDING OUR OWN SITES.

THE GREEN LINE THERE IS JUST TO SHOW THE AVERAGE OF THE TOP TEN SITES.

SO IT'S WELL ABOVE THE AVERAGE OF THE TOP TEN SITES.

THE REASON I BRING THIS UP IS BECAUSE THIS IS ONE OF THE FEW LEASES WHERE I'VE SEEN WHERE WE'RE ACTUALLY TASKED WITH MAINTAINING THE ROAD.

AND SO I JUST WANTED TO MAKE SURE THAT WE DIDN'T HAVE ANY PROBLEMS WITH MAINTAINING THE ROAD, AND ALSO THAT THE INCOME THAT WE GET IS SOME OF THAT BEING PUT INTO OUR MEANING SEQUESTERED SO THAT WE CAN ACTUALLY GO TOWARDS THIS.

OKAY. OKAY, SO I GUESS SOUNDS LIKE WE I GUESS WE THAT ROAD SURVIVED THE STORMS OF THE PREVIOUS YEARS AND HAD HASN'T HAD ANY MAJOR MAINTENANCE ISSUES THERE.

AND YOU KNOW, THESE COMMUNICATION SITES OR THESE TELECOMMUNICATION SITES ARE REALLY IMPORTANT, AS YOU MENTIONED, WITH THE PUBLIC BENEFIT AND EVERYBODY WITH, YOU KNOW, A SMARTPHONE OR ALMOST EVERYBODY WITH A SMARTPHONE.

AND I DO KNOW THAT THERE'S SOMETIMES SOME CONTROVERSY AS WELL.

SO I RECOGNIZE THAT THIS IS A SITE THAT HAS BEEN IN EXISTENCE AS A TELECOMMUNICATION SITE SINCE 1963.

THAT'S A REALLY LONG TIME. SO I CERTAINLY SUPPORT THIS.

AND IF ANYTHING, I THINK KEEP, YOU KNOW, A BOOKMARK ON THIS PRESENTATION BECAUSE I DO BELIEVE, YOU KNOW, AFTER WE REVIEW THE UPCOMING IT SERVICES STRATEGIC PLAN, THERE MAY BE ANOTHER CONVERSATION ABOUT THIS.

YOU KNOW, BASICALLY REORGANIZED THE PARK OPERATIONS DEPARTMENT WITH THAT.

THE PREVIOUS MODEL AND SOME MAY REMEMBER THAT IT WAS BASED UPON EIGHT GEOGRAPHIC AREAS.

WITH THAT, THEY CONVERTED IT TO BASICALLY SIX UNIT AREAS, WHICH WERE COMPRISED BASED UPON THEIR FUNCTIONALITY AND ACTIVITIES TYPE.

THE PARK DISTRICT WAS RELATIVELY SMALL AT THAT TIME IN CONSIDERATION OF 46,000 ACRES AND APPROXIMATELY 40 PARKS.

WITH THE INCIDENT WITH COVID THAT HIT, OUR PARKS REMAINED OPEN FOR USE.

AND A LOT OF PEOPLE FOUND OUR PARKS AND USED THEM AS YOU KNOW, BASICALLY A WAY TO RECREATE FOR HEALTHFUL ACTIVITY LIFESTYLES. SO THAT IN TURN PUT HIGHER DEMANDS ON OUR PARKS, OF COURSE.

AND JUST GOING BACK TO ON YOU KNOW, BAY AREA POPULATION INCREASE, WHAT WE'VE ALSO SEEN BASICALLY WITH THAT IS THE DRIVE TIME TO GET FROM PARK TO PARK.

FREEWAYS PENDING ON WHERE YOU'RE GOING AND WHAT DIRECTION, WHAT TIME OF DAY HAS SIGNIFICANTLY INCREASED THE DRIVE TIME TO GET TO EACH PARK.

SOME OF MY UNIT MANAGERS CAN TAKE UP TO AN HOUR, HOUR AND A HALF TO GET TO ONE OF THEIR LOCATIONS IN THE CURRENT CONFIGURATION THAT'S AT RIGHT NOW.

WE TOOK A LOOK AT THE STAFFING MODELS.

IT VARIED FROM AREA TO AREA DEPENDING ON WHAT THE FUNCTIONALITY OR ACTIVITY WAS FOR EACH UNIT.

OUR INTERPRETIVE PARKLANDS HAD SIGNIFICANTLY GROWN WITH THE ACQUISITIONS OF THE NEW PROPERTIES IN THE EASTERN COUNTIES.

AND THEN OF COURSE, THAT AFFECTS SPAN OF CONTROL AS WELL.

SO ONE OF THE THINGS THAT WAS REALLY HIGH ON THEIR LIST WAS, HEY, LET'S TAKE A LOOK AT REORGANIZING PARK OPERATIONS.
